The Ministry of MSME Issues Decree No. 3/2026 to Protect Online Sellers

JAKARTA - The Ministry of Micro, Small and Medium Enterprises (UMKM) officially issued the Minister of Micro, Small and Medium Enterprises (Permen) Regulation Number 3 of 2026 concerning the Protection and Improvement of the Competitiveness of Micro Enterprises and Small Enterprises in Trade through Electronic Systems (PMSE).

This regulation serves as a legal basis and reference for e-commerce platforms or Electronic Trading System Operators (PPMSE) in building fair, transparent, and equal partnerships with micro and small business actors (UMK) who sell online throughout Indonesia.

Deputy for Small Business of the Ministry of MSME, Temmy Satya Permana, said that the regulation was a tangible step by the government to strengthen protection for MSME entrepreneurs in the digital trade ecosystem while increasing the competitiveness of local products.

"Through this regulation, every e-commerce platform is required to clearly list all types of fees charged to UMK entrepreneurs in partnership agreements," said Temmy, Wednesday, June 24.

The information must include the amount of the cost, the calculation mechanism, and the procedures for periodic and transparent payment. Thus, any changes to the cost components can no longer be unilaterally determined by the platform, but must be based on a mutual agreement with UMK partners.

"With the implementation of a partnership agreement that clearly regulates all agreed and imposed costs on UMK entrepreneurs, they have certainty in running their business," said Temmy.

He hopes that the problem of unilateral cost increases that occur suddenly and too often in the future will not be repeated.

To ensure transparency, e-commerce platforms are also required to submit a notification regarding the planned change in fees no later than 90 calendar days before the policy is implemented.

If within that period the UMK entrepreneur feels objections to the proposed changes, they have the right to apply for facilitation of negotiations to the Minister of MSME through the SAPA UMKM application. The results of the facilitation are then included in the amendment to the partnership agreement that binds both parties.

In addition to strengthening the legal protection aspect, the Decree of the Minister of MSME Number 3 of 2026 also presents stimuli to increase the competitiveness of domestic products through promotional and marketing incentives.

In the regulation, e-commerce platforms for non-UMK categories are required to provide a minimum 50 percent discount on service fees for each transaction obtained by verified UMK entrepreneurs who only sell Domestic Products. This facility can be submitted directly by business actors through the SAPA UMKM integrated service platform.

"We realize that UMK is facing increasingly fierce competition, including due to the proliferation of imported products on e-commerce. To maintain the competitiveness of local products, we have prepared an incentive scheme in the form of a minimum 50 percent reduction in service costs. This policy is expected to help UMK maintain a healthy business margin while ensuring their products remain competitive in the digital market," said Temmy.

According to the closing provisions, this regulation provides a maximum transition period of six months to prepare for the technical implementation of the incentive system. However, the Ministry of MSME emphasized its commitment to accelerate the data integration and verification process with all digital platform organizers.

"We will not wait until the six-month deadline expires. Once the technical preparations are completed and the system infrastructure is ready, this service cost reduction incentive will immediately be utilized by UMK entrepreneurs. Currently, we continue to work intensively with the e-commerce platform management so that this policy can be realized immediately," he said.
