Reply Kapitra Ampera, Komnas HAM: Based On The Law, We Have The Right To Call Anyone
JAKARTA - Commissioner for Monitoring and Investigation of the National Human Rights Commission (Komnas HAM) Choirul Anam asserted that his party has the right to summon anyone based on the applicable laws.
This was conveyed by him in response to the statement of PDI-P politician Kapitra Ampera. At that time, he said that Komnas HAM had no right to summon the chairman of the Corruption Eradication Commission (KPK) regarding alleged violations in the National Insight Test Assessment (TWK), which is a condition for the transfer of employment status.
"Based on Law Number 39 of 1999 concerning Human Rights, the authority of Komnas HAM is regulated. Where Komnas HAM has the right to summon anyone," Anam said in a press conference broadcast on Komnas HAM YouTube, Wednesday, June 9.
"Komnas HAM has the right to summon anyone," he added.
Previously, Kapitra asked the KPK leadership not to ignore the summons made by Komnas HAM. He also considers the commission's investigation related to TWK's chaos which caused 75 employees to be declared ineligible as well as an oddity.
The reason is that based on Law No. 26 of 2000 on the Human Rights Court, Komnas HAM is the institution authorized to investigate gross human rights violations.
"The authority of Komnas HAM according to Law No. 26/2000 is only limited to gross human rights violations in the form of crimes against humanity and genocide," he said.
For information, the National Insight Test was attended by 1,351 KPK employees. Of these, 1,274 people were declared eligible.
Meanwhile, 75 employees, including Novel Baswedan, Chairman of the KPK Employee Forum who is also investigator Yudi Purnomo, Director of Socialization and Anti-Corruption Campaign Giri Suprapdiono, Head of the KPK Task Force Harun Al-Rasyid, and Director of PJKAKI Sujarnarko were declared ineligible (TMS). While the other two employees did not attend the interview test.
According to the employees who were declared unsuccessful, there were a number of anomalies in the implementation of this assessment. Including, there are a number of questions that are considered to violate the private sphere.
These employees who did not pass, then reported the implementation of the TWK to Komnas HAM. Subsequently, a special team was formed, led by two commissioners, namely Choirul Anam and Sandrayati Moniaga to investigate the alleged human rights violations in this test.
In addition to submitting reports to Komnas HAM, these employees also reported their leadership to a number of parties, from the KPK Supervisory Board to the Indonesian Ombudsman.
