Former Director of Kepahiang Hospital, the Defendant in the UPS Corruption Case, was sentenced to 3 years in prison, paying Rp. 530 million in compensation.
BENGKULU - The Bengkulu District Court's Corruption Crime Court Panel of Judges sentenced the former Director of the Kepahiang Hulman District General Hospital, August Erikson Marpaung, to 3 years in prison and a fine of Rp. 50 million, plus 50 days in prison.
The defendant, Hulman August Erikson Marpaung, was also sentenced to an additional penalty in the form of paying compensation of Rp. 530 million related to the corruption case in the procurement of uninterruptible power supply (UPS) in the 2020 and 2021 fiscal years.
"Declaring the defendant to be proven legally and convincingly to have committed the crime of corruption together as referred to in the sub-article," said the Chairman of the Bengkulu PN Corruption Court Panel of Judges Agus Hamzah when reading the verdict in Bengkulu City, Wednesday, June 3, reported by ANTARA.
The panel of judges also sentenced M. Ridwan Lubisselaku, a service provider or UPS contractor at the Kepahiang Regency Hospital, who is currently still at large (person search list/DPO), to 3 years in prison and a fine of Rp. 50 million, with 80 days in prison, and must pay compensation of Rp. 443.56 million with a substitute penalty of one year.
Public Prosecutor (JPU) of Kepahiang District Prosecutor's Office Hafiedz Assegaf stated that the seizure of assets that had been carried out against the defendant Hulman would be calculated as an effort to return state losses.
"In the decision, all our demands have been accommodated, but regarding the differences, we will report to the superiors first," he said.
Previously, the Kepahiang District Attorney's Office charged the former Director of the Kepahiang Regency Hospital, Hulman August Erikson, with a sentence of five years in prison, a fine of Rp. 50 million, a substitute sentence of 3 months in prison, and was required to pay compensation of Rp. 532 million, which if unable to pay will be subject to a substitute sentence of 2 years and 6 months in prison.
For the defendant M. Ridwan Lubis, the service provider or UPS contractor at the Kepahiang Regency Hospital was sentenced to 5 years in prison, a fine of Rp. 50 million, a 3-month substitute fine, and was ordered to pay Rp. 443 million in substitute money with a substitute sentence of 2 years and 6 months.
The Kejari Kepahiang Rizka Ari Kholifatur Rohman prosecutor explained that for the return of state losses from the defendant Ridwan who has been designated as a DPO, his party is still waiting for the decision of the panel of judges.
The modus operandi used by the former Director of Ketamin Hospital was when he carried out the procurement of goods and services with the e-purchasing or e-catalog method for the procurement of two UPS units in the 2020 fiscal year worth Rp1.49 billion.
Furthermore, in the 2021 fiscal year, Kepahiang Hospital again procured two UPS units worth Rp. 1.79 billion. The procurement of UPS in the 2020 and 2021 fiscal years was sourced from the Special Allocation Fund (DAK).
