Sengketa Merek Dagang XPDC Mencuat, PT Xentra Layangkan Somasi

TANGERANG - Disputes over alleged trademark violations have resurfaced in the national logistics industry. PT Xentra Platform Digital Cargo through its legal representative, Sogi Bagaskara, officially served a summons to PT Xena Pranadipa Dhia Cakra regarding the alleged use of the "XPDC" trademark without rights.

The summons is related to the alleged use of the Registered Trademark "XPDC" with Registration Number IDM001453660 Class 39 which has legal protection under Law Number 20 of 2016 concerning Trademarks and Geographical Indications.

The lawyer for PT Xentra Digital Platform Cargo, Sogi Bagaskara, said that the legal action was taken after his party conducted a search and collected evidence on the ground.

"It was found that there was an alleged use of names, logos, identities, attributes, domains, social media, websites, electronic systems, business branding, and various other forms of commercial identity that have similarities in essence with the Registered Trademark 'XPDC' belonging to our client," said the legal representative in a written statement.

According to him, the identity that allegedly resembles the brand "XPDC" is used in various business activities in the fields of logistics, freight forwarding, shipping, and other related services.

The use is said to include website domains, social media accounts, Google Maps naming, operational vehicle branding, office signage, company email, and electronic system dashboards.

PT Xentra emphasized that the right to registered trademarks is an exclusive right protected by law. Therefore, any use without permission is considered to be a violation of the law and has the potential to meet the elements of criminal acts as stipulated in Article 100 paragraph (1) and/or paragraph (2) of Law Number 20 of 2016.

Through the summons, PT Xentra asked PT Xena Pranadipa Dhia Cakra to immediately stop all use of the "XPDC" identity, including taking down and deleting all attributes related to the brand.

The legal representative gave a deadline of three calendar days from the receipt of the summons to take corrective action.

"If, within the specified period, there is no corrective action or good faith from the parties concerned, PT Xentra through its legal representative states that it is ready to take further legal steps that are more firm," he said.

In addition, the legal representative stated that he would take the criminal path by making a police report to the Polda Metro Jaya regarding the alleged criminal offense of trademark infringement.

"This step is emphasized as an effort to protect legal rights as well as maintain legal certainty and a healthy business climate in Indonesia," he concluded.
