Considered 'Not Clear', the Supreme Court Rejects the Complaint of Burnt Internet Quota
JAKARTA - The Constitutional Court (MK) stated that case number 87/PUU-XXIV/2026 tested the material of Article 71 paragraph 2 of Law Number 6 of 2023 concerning Cipta Kerja which questioned the unclear or unclear (obscuur) waste internet quota.
In the consideration read by Constitutional Judge Saldi Isra, the applicant in the applicant's authority did not elaborate on the legal basis for the Constitutional Court's authority to test laws against the 1945 Constitution in full as determined in Regulation of the Constitutional Court Number 7 of 2025.
In this case, the applicant only mentions Article 24C paragraph (1) of the 1945 Constitution and Article 10 paragraph (1) letter A of the Constitutional Court Law and adds the sentence "The Constitutional Court serves as The Guardian of Constitution and The Protector of Citizen's Constitutional Rights".
"Likewise, in the legal position, the applicant only lists five points of the conditions for constitutional rights without being associated with the substance of constitutional rights," said Saldi.
Furthermore, in the posita (grounds for the application) section, the applicant did not adequately elaborate on the reasons that could show a conflict between the norms of Article 71 paragraph 2 of Law Number 6 of 2023 with the basis of the 1945 Constitution.
"Based on the facts and legal considerations of each of the above petitioners, there is no doubt for the Court to declare the quo application unclear, vague or obscure," said Saldi.
Saldi continued, considering that the Court has the authority to try the quonamun petition because the quo petition is unclear, or vague, then the Court does not further consider the applicant's request.
Case number 87/PUU-XXIV/2026 questioning the expired internet quota was filed by Rachmad Rofik. There are at least 31 similar cases currently being processed at the Constitutional Court. One of them is number 273/PUU-XXIV/2026 which was requested by Didi Supandi, an online motorcycle taxi driver and Wahyu Trisna Sari, an online culinary trader.
