UN Version of the VI Bali Congress Challenges the SK Menkum to the PTUN: A Form of Indiscretion
JAKARTA - The Central Leadership Council (DPP) of the PBB, which is the result of the VI Bali Congress, sued the Decree (SK) of the Minister of Law to the State Administrative Court (PTUN) in Jakarta today. The disputed policy is numbered M.HH-3.AH.11.02 Year 2026 which approves the composition of the DPP PBB leadership as a result of the Party Council (MDP) Meeting.
The General Chair of the Bali VI Congress, Gugum Ridho Putra, said this step was taken because his party considered that there was arbitrariness in the issuance of the decision.
"We, the Party of the Crescent Moon, today filed a state business regulation lawsuit against the decision of the Minister of Law of the Republic of Indonesia to approve the (management structure) of the MDP camp which is not valid. With his SK, thank God we have learned and we have received it, number M.HH-3.AH.11.02 Year 2026," Gugum told reporters, Tuesday, April 29.
Since the SK was issued, Gugum said, there has never been an official announcement to the public. This then became an important note that was also submitted in the lawsuit to the PTUN.
"Of course, this is also a note that we have submitted to the TUN Court (Jakarta) as a form of bad faith to hinder us, the DPP of the Moon Star Party, the results of the VI Bali Congress, in defending our rights as legitimate managers and in maintaining our legal rights," he said.
His party wants to prove two things through the lawsuit he filed. First, the SK is considered contrary to laws and general principles of good governance.
Gugum emphasized that his party had submitted a clarification to the Minister of Law before the decision was issued. "That we are the DPP of the Party of the Crescent Moon which is legitimate, because it was produced from the VI Congress of the Party of the Crescent Moon in Bali. In the clarification letter that we submitted, we have also shown evidence that the party who claimed the results of the MDP was produced by an illegal meeting process," he said.
Second, he questioned the decision of the MDP to replace the general chairman without a clear legal basis. "We have conveyed all of this to the Minister of Law, but the Minister of Law still ignored it and issued a certification to the party that is not entitled and not valid," said Gugum.
Meanwhile, the Secretary General of the PBB DPP, Ali Amran Tanjung, said that this lawsuit was a step to uphold the constitution.
"When there is a violation of the Articles of Association and the House Budget, especially by the government, in this case the deputy mayor, then in fact the deputy mayor is ignoring what the law requires," he said.
The PBB camp, which was the result of the VI Bali Congress, has also filed a lawsuit to test the material of the Political Party Law with the Constitutional Court (MK) on April 20, 2026. The lawsuit targets Law Number 2 of 2008 and Law Number 2 of 2011 as part of efforts to strengthen the legitimacy of party management.
