Judge at Tais Bengkulu PN Denies Being Actively Involved in the Little Aresha Daycare Foundation
JAKARTA - The judge with the initials Rafid Ihsan Lubis (RIL) at the Tais District Court (PN), Seluma Regency, Bengkulu, denied being actively involved in the management of the Little Aresha Daycare Foundation in Yogyakarta.
"Judge RILtak has never been involved in operational activities or decision-making at the foundation, but only helped in the early stages of establishment," said a spokesman for the Tais Rohmat District Court in Seluma Regency, Tuesday, April 28.
He explained that in 2021, the foundation's owner had asked RIL for help in lending an electronic identity card (KTP) as one of the administrative requirements for establishing a legal entity.
He said RIL conveyed the condition that if his name must be removed from the management structure after the legal entity of the foundation was officially formed.
The request was made after RIL was declared to have passed the civil servant (CPNS) candidate for judges and was not allowed to engage in activities outside his duties as a state apparatus.
Rohmat emphasized that RIL had never received any kind of reward from the foundation and did not know the process of establishing the foundation, including the issuance of a notary deed on July 5, 2022.
"RIL has never gone to a notary, has not signed the deed of incorporation and has never given power of attorney to another party to act on its behalf in the legal process," he said.
Based on the statement of claim submitted, RIL explained that he had never made a capital contribution, did not attend the board of directors meeting, and did not receive any honorarium, wages, or profits from the foundation's activities.
As well as never being involved in decision-making or follow-up communications related to the foundation's operations.
For all activity reports, including the foundation's finances and operations, he said, they were never submitted to RIL and the person concerned never signed any documents related to the management of the foundation.
Rohmat said RIL admitted that its actions of lending personal identity in 2021 were a mistake and a form of negligence, so he apologized to the victims and the families of the victims affected by the foundation's controversy.
Previously, the Little Aresha Daycare in Yogyakarta was reported to the police regarding alleged violence and discrimination against children who were entrusted there.
The police then raided the daycare on Friday (24/4). At least 53 children were suspected of experiencing violence, discrimination, and abandonment of 103 children entrusted at the daycare.
The police have named 13 people as suspects. Eleven people are caregivers, the other two are DK (51) as the head of the foundation and AP (42) as the headmaster.
Meanwhile, the other eleven people are FN (30), NF (26), Lis (34), EN (26), SRm (54), DR (32), HP (47), ZA (30), SRj (50), DO (31) and DM (28).
