Corruption Accused Of Housing Rehabilitation Fund In Aceh Sentenced To 2 Years In Prison
BANDA ACEH - A panel of judges at the Banda Aceh Corruption Court sentenced two defendants to two years in prison for corruption in funds for the rehabilitation of uninhabitable houses in Aceh Singkil Regency.
The verdict was read out by the panel of judges chaired by Dahlan during a hearing at the Banda Aceh Corruption Court in Banda Aceh, Monday, June 7.
In addition to sentenced two defendants to two years in prison, the panel of judges also sentenced another defendant to one year and two months in prison.
The two defendants who were sentenced to two years in prison were Teuku Rahmadi and Rahmat Syah. Teuku Rahmadi is the official implementing technical activities (PPTK) for the rehabilitation of uninhabitable houses. While the defendant Rahmat Syah as the treasurer of the service.
Meanwhile, the defendant Jaruddin is the former Head of Social Manpower and Transmigration of Aceh Singkil Regency and also the former Expert Staff of the Aceh Singkil Regent. The defendant Jaruddin was sentenced to one year and two months in prison.
The trial took place virtually. The three defendants attended the trial from the Singkil Penitentiary, where they were detained. The three defendants were accompanied by legal counsel and attended by Public Prosecutor (JPU) Alfian from the Aceh Singkil District Attorney's Office.
The panel of judges declared the defendants guilty according to the subsidiary charges, violating Article 3 Jo. Article 18 of Law Number 31 of 1999 which was changed to Law Number 20 of 2001 concerning the Eradication of Corruption Crimes Jo. Article 55 paragraph (1) of the 1st Criminal Code.
In addition to the sentence of imprisonment, the panel of judges also sentenced the three defendants to pay a fine of Rp. 50 million each with a subsidiary or a substitute sentence of three months in prison.
The panel of judges also sentenced the defendant Juraddin to pay compensation for state losses of Rp7.6 million. Meanwhile, the defendant Teuku Rahmadi was sentenced to pay compensation of Rp. 27.6 million and the defendant Rahmat Syah to pay compensation of Rp. 47.6 million.
"The replacement money is paid after the decision has permanent legal force. If the defendant does not pay the state losses, the property will be auctioned off. If the defendant does not have property, he will be sentenced to five months in prison," said the panel of judges.
The defendants and their legal advisors expressed their thoughts on the judge's decision. Likewise, the Public Prosecutor expressed his thoughts. The panel of judges gave 14 days for a period of thought.
Previously, Public Prosecutor Alfian said the Office of Social Manpower and Transmigration of Aceh Singkil Regency managed a budget of Rp. 1 billion in 2016 to fund the rehabilitation of uninhabitable houses.
However, based on the report on the results of the audit team of the Aceh Singkil District Inspectorate regarding the budget management for the rehabilitation of uninhabitable houses, the state lost Rp.232.8 million.
The defendants have also returned the state compensation of Rp. 150 million during the investigation, so that the remaining Rp. 82 million, said Public Prosecutor Alfian.
