Instagram Post Deleted, PT Zarah Benuanta Utama Submits Evidence to Investigators
TARAKAN - PT Zarah Benuanta Utama mengambil langkah hukum menyusul beredarnya konten di media sosial yang dinilai merugikan reputasi perusahaan. Laporan resmi telah disampaikan kepada aparat penegak hukum di Polres Kota Tarakan.
The President Director of PT Zarah Benuanta Utama, Firman Pamungkas, through his legal team stated that the content circulating on Instagram contained a number of information that was considered not in accordance with the facts and had the potential to create a negative perception in the public.
The company's lawyer, Mukhlis Ramlan, explained that the legal action was taken as an effort to provide certainty and straighten out information that has developed in the community.
"This step is not merely to respond to criticism, but because there is an allegation of providing incorrect and harmful information to our clients," said Mukhlis, at the Tarakan Police, Monday (30/3/2026).
According to him, the company has submitted a number of documents and supporting evidence to investigators, including screenshots of the disputed content and data related to the company's activities.
In the content, he said, there were a number of narratives that linked the company with practices that were considered inappropriate, including issues of budget management and the company's internal structure.
Mukhlis emphasized that all of the company's activities so far have been carried out in accordance with the applicable mechanisms. He said that cooperation with various parties, including local governments, was carried out through official and open procedures.
"All the cooperation process is carried out transparently and in accordance with existing regulations. There is no special treatment for our company," he said.
He also highlighted the mention of other parties in the content which was considered irrelevant to the substance of the issue. According to him, this has the potential to expand the negative impact of unverified information.
"The information circulating not only targets companies, but also drags other parties that have no direct connection," he said.
Furthermore, his party assessed that the dissemination of the content had crossed the limits of constructive criticism and entered the realm of alleged violations of the law, especially regarding defamation through electronic media.
Regarding the allegation of a contract value of billions of rupiah, Mukhlis said that this year PT Zarah Benuanta Utama has not had a contract with the North Kalimantan Provincial Government. Meanwhile, in the previous year, the value was also not as large as alleged.
"If the total of 126 media is perhaps billions, but if it is called a monopoly by Benuanta Utama, it is wrong and misleading," he said.
In the report, his party referred to legal provisions, including Article 433 jo 434 of the Criminal Code of Law Number 1 of 2023, as well as the Electronic Information and Transaction Law (ITE Law) Article 27A jo Article 45 paragraph (4) regarding alleged insults, defamation, and dissemination of misleading information.
In addition, the lawyer also opened the possibility of other alleged violations, including the leakage of internal company data such as invoices and contracts.
"This can be included in the suspicion of data theft and there are other criminal consequences that we will take," he said.
Regarding the reported party, Mukhlis said there were several accounts involved in the dissemination of the content, including an account with the initials O who shared it in the Kaltara Info group, as well as the party suspected of creating and designing the content which was said to be an organization in Kaltara with the initials HTS.
"Furthermore, we leave it entirely to the investigators to follow up, including the summoning of witnesses and the reported parties," he concluded.
