Eight Defendants in the TKA Permit Extortion of the Ministry of Manpower are Charged with 4-9.5 Years in Prison
JAKARTA - A total of eight defendants in the alleged extortion case in the management of the Foreign Manpower Use Plan (RPTKA) permit at the Ministry of Manpower were sentenced to prison terms of 4 years to 9 years and 6 months.
Public prosecutor (JPU) from the Corruption Eradication Commission Nur Haris Arhadi believes that the defendants have been proven to be legally convinced of their guilt under the law of committing corruption, as the public prosecutor's first indictment.
"The criminal is regulated in Article 12 letter ejuncto Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) jo. Article 64 paragraph (1) of the Criminal Code," said the JPU in the reading of the letter of demand at the Corruption Court at the Jakpus PN, Monday, March 30, reported by ANTARA.
The JPU detailed that the Director General of Manpower Placement and Employment Opportunity Expansion (Dirjen Binapenta and PKK) of the Ministry of Manpower for the period 2020-2023, Suhartono, was required to be sentenced to 4 years in prison.
Then, three staff of the Directorate of Foreign Manpower Control (PPTKA) at the Ministry of Manpower's Binapenta and PKK Directorate for the period 2019-2024, namely Putri Citra Wahyoe, Jamal Shodiqin, and Alfa Eshad, were ordered to be sentenced to 6 years in prison each.
Then, the Coordinator for the Feasibility Test for the 2020-2024 PPTKA Certification and Director of the 2024-2025 PPTKA Ministry of Manpower Devi Angraeni, were sentenced to 6 years and 6 months in prison.
Furthermore, the Head of the Maritime and Agriculture Subdirectorate of the Directorate General of Binapenta and PKK for the period 2019-2021 and Foreign Labor Analysis and Control Coordinator of the Foreign Labor Analysis and Control Directorate of the Directorate General of Binapenta and PKK of the Ministry of Manpower in 2021-2025, Gatot Widiartono, was sentenced to 7 years in prison.
Meanwhile, the Director General of Binapenta and PKK of the Ministry of Manpower for the period 2024-2025 and the Director of PPTKA of the Ministry of Manpower for the period 2019-2024 Haryanto and the Director of PPTKA of the Ministry of Manpower for the period 2017-2019 Wisnu Pramono, were each charged with 9 years and 6 months of imprisonment.
Not only prison sentences, the eight state civil servants (ASN) of the Ministry of Social Affairs were also ordered to be sentenced to a fine, namely Suhartono for Rp. 150 million with the provision that if it is not paid, it will be replaced (subsider) with a prison sentence of 70 days.
The JPU added that the fine imposed on Devi, Putri, Jamal, and Alfa, each worth Rp350 million, was a subsider of 110 days in prison.
For Gatot, he was ordered to pay a fine of Rp500 million, subsider 140 days of imprisonment, while for Haryanto and Wisnu, each Rp700 million, subsider 160 days of imprisonment.
In addition to Suhartono, the seven defendants were also asked by the JPU to be given additional punishment in the form of payment of compensation in different amounts.
In detail, Haryanto was Rp84.72 billion subsider 6 years in prison; Wisnu Rp25.2 billion subsider 4 years in prison; Gatot Rp9.48 billion subsider 3 years in prison; Devi Rp3.25 billion subsider 3 years in prison; Putri Rp6.39 billion subsider 2 years in prison; Jamal Rp551.16 million subsider 1 year in prison; and Alfa Rp5.24 billion subsider 2 years in prison.
In the case that occurred in the environment of the Ministry of Manpower in the period 2017-2025, the eight ASN were charged with extorting a company agent for managing RPTKA permits of Rp. 135.29 billion.
The eight defendants are also suspected of asking the agents to provide goods in the form of one unit of Vespa motorcycle type Primavera 150 ABS A/T and one unit of Innova Reborn car.
It is stated that the eight defendants have forced the employers and RPTKA management agents who apply to provide a certain amount of money or goods and if it is not fulfilled, the RPTKA application will not be processed.
The extortion was carried out to enrich the ASN of the Ministry of Manpower, namely enriching Putri by Rp6.39 billion; Jamal Rp551.16 million; Alfa Rp5.24 billion; Suhartono Rp460 million; Haryanto Rp84.72 billion and one unit of Innova Reborn car; Wisnu Rp25.2 billion and one unit of Vespa motorcycle type Primavera 150 ABS A/T; Devi Rp3.25 billion; and Gatot Rp9.48 billion.
For their actions, the defendants are threatened with criminal penalties as provided for in Article 12e or Article 12B jo. Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) jo. Article 64 paragraph (1) of the Criminal Code.
