Child Custody Rights Fall into the Hands of Mawa, Insanul is Allowed to Meet with Certain Conditions

JAKARTA - Although the mediation regarding the divorce failed, there was a meeting point regarding the future of their children. The Insan party as the defendant reportedly did not mind if the custody of the children fell entirely into Mawa's hands.

"Regarding child custody, the defendant does not object to the child custody falling into the hands of the plaintiff. However, the defendant asked to be given access to see his child," said Muhammad Idris, Wardatina Mawa's lawyer via zoom, Wednesday, March 25.

The access to the meeting requested by Insan has been agreed in writing in the mediation. However, Idris emphasized that the meeting should not interfere with the child's main obligation, namely school.

"The agreement was that in writing, yes, access was given to see the child without hindering his school. There is a specific time. Outside school hours, one. After school, you can meet," he explained in detail.

Apart from the time factor, there is an important point in the agreement, namely the factor of the child's willingness. Idris emphasized that the meeting could only take place if the child really wanted to meet his father.

"As long as the child is willing to meet. And that is if the child wants to meet the defendant, it is okay. However, if the child's party does not want to meet his father, it is impossible to force it," said Idris.

So far, Idris claims that his client, Mawa, never had the intention to sever the ties of kinship between father and son. During the legal process, access was always given openly.

"The problem for meeting the child, so far from the plaintiff's side is not difficult. Access is still given, that's it. But if you have met or not at this time in Medan, I don't know the confirmation," he added.

Now, both parties are waiting for the next court session to report the results of this mediation to the panel of judges. Legal representatives are still waiting for official notification from the court.

"We are waiting for the court, for the agenda to report the results of the mediation. Later, the court will send us an email, for the next court hearing schedule," said Idris closing the discussion regarding the fate of his client's child.
