Haris Azhar Says Lee Kah Hin's False Testimony Case is Broken: It is Imperfect in KUHAP
JAKARTA - Haris Azhar as the lawyer for the Director of PT Wana Kencana Mineral, Lee Kah Hin, considers that the case of providing false testimony by his client does not meet the principles of human rights (HAM).
This was conveyed by Haris after the pretrial hearing filed by Lee Kah Hin today, March 11. The company's boss sued the determination of the suspect and detention in the case of providing false testimony under oath in the trial process by the Polda Metro Jaya investigators.
"This case is legally broken. It means it is not perfect," Haris told reporters.
Haris explained that this assumption arose because the case did not meet legal standards based on human rights. "Article 14 of the ICCPR (International Covenant on Civil and Political Rights), there is a standard for a fair trial, to guarantee human rights," said Haris.
In this principle, he said, there must be a balance for a person who is suspected of defending himself. "Well, the rights of these suspects to convey the truth and expert and witness testimony are also not accommodated," he said.
Lee Kah Hin's other lawyer, Rolas Sitinjak, also said that the right to defend himself was not accommodated because the witnesses and experts requested by his client were not included in the case file.
"Experts were invited, but the file was immediately sent (to the Prosecutor's Office, ed.), Without waiting for experts to come in for questioning," said Rolas.
"Witnesses were invited, but not examined, on the grounds that the file had been sent," he continued.
Meanwhile, Maqdir Ismail, who is also Lee Kah Hin's lawyer, highlighted the suspicion of false oaths imposed on his client. "They (witnesses and experts) explained that there was no false oath. Meanwhile, the main suspicion is a false oath," he said.
The statement highlighted by Maqdir was made by former Wakapolri Komjen (Ret.) Oegreseno. As an expert, the explanation has been given that the suspicion can arise if there is a reprimand and order of the judge because the judge knows that there is incorrect testimony from a witness or defendant.
In addition to Oegroseno, who was an expert in the trial, were Chairul Huda, Professor of Criminal Law at the University of Muhammadiyah Jakarta and Mahrus Ismail and the Indonesian Islamic University. From their statements, Maqdir said, the Information Report was not known in the criminal legal process.
"KUHAP only knows the police report as the basis for starting the investigation process," he said.

Lee Kah Hin is known to be a suspect in false testimony after testifying in a trial at the Central Jakarta District Court in October 2025. He then testified as a witness who was presented by the public prosecutor together with Eko Wiratmoko.
Lee Kah Hin's statement has been included in the file by the police investigators.
The trial tried the installation of a peg in the Izin Usaha Pertambangan area of PT WKM. The problem arose after PT Position reported Awwab and his colleague Marsel Bialembang to the police until they became defendants.
The cases of Awwab and Marsel were decided by the judge in December 2025. Meanwhile, the intelligence report was carried out a month before the judge decided the verdict or in November 2025.
Regarding the case that ensnared Lee Kah Hin, Haris Azhar as a lawyer previously suspected that there was a trade war between nickel companies in Weda Bay or Weda Bay, in East Halmahera, North Maluku. The suspicion arose because Ardiyanto represented PT Position when he reported to the Polda Metro Jaya.
This suspicion is getting stronger because there is a dialogue between PT WKM and PT Position, which is a subsidiary of PT Harum Energy, Tbk. This effort appears outside the legal process.
