Commission III of the DPR holds RDPU regarding the Bibi Kelinci Restaurant Case, Nabilah O'Brien's Value Does Not Violate the Law
JAKARTA - Commission III of the DPR held a public hearing (RDPU) with the owner of the Bibi Kelinci restaurant in Kemang, Mampang Prapatan, South Jakarta (Jaksel), Nabilah O'Brien, and her lawyer regarding the alleged theft of food by a married couple (pasutri).
This meeting was a follow-up to Nabilah's report to Commission III of the DPR on Friday, March 6.
In this case, Nabilah O'Brien is a theft victim who is a suspect in a defamation case and is being sued for Rp1 billion.
Chairman of Commission III of the DPR, Habiburokhman, said his party needed to respond to this as a form of constitutional implementation of the DPR to carry out oversight.
"Since last Saturday, we have been in intensive communication with our partners, namely the National Police, we have facilitated finding a solution that is in accordance with the law. Alhamdulilah, last night on Sunday the report against Ms. Nabila O'Brien was revoked and by itself. Ms. Nabila O'Brien is no longer a suspect and this matter has been stopped," said Habiburokhman at the DPR building, Senayan, Jakarta, Monday, March 9.
On the other hand, continued Habiburokhman, Nabila O'Brien has also forgiven the suspect in the theft case and withdrawn the report. He emphasized that Commission III of the DPR as the party that discusses and approves the new Criminal Code and Criminal Procedure Code is committed to ensuring that the two great works can actually be implemented starting from their spirit, their principles, to their legal norms.
"With the enactment of the new Criminal Code and Criminal Procedure Code, drastic changes in our legal paradigm should have occurred, from previously pursuing retributive and formalistic justice to restorative, rehabilitative and substantive justice," said Habiburokhman.
According to the Gerindra legislator, not all legal disputes in society must be resolved in court. Minor legal disputes in society, said Habiburokhman, as much as possible be resolved within the family outside the court.
"In particular, President Prabowo Subianto has left a message for us to avoid mistakes in the judicial process or misscariage of justice to ensure that small people who are in litigation can smile because they get justice," he said.
Habiburokhman said, the RDPU of Commission III of the DPR together with Nabilah O'Brien and her lawyer reached a binding conclusion. First, Commission III of the DPR asked law enforcement officials in investigating criminal acts, especially related to defamation and defamation, to comply with the provisions of the new Article 36 of the Criminal Code which stipulates that no one can be held criminally responsible without the fulfillment of the element of intent that is indisputable.
"Second, the Commission III of the DPR RI considers that Ms. Nabila O'Brien has not actually fulfilled the elements of illegality and the elements of intention to slander or defame another person," said Habiburokhman.
"Commission III of the DPR RI supports the revocation of the status of suspect against Ms. Nabila O'Brien and the termination of this case with a restorative justice mechanism that is not burdensome," he added.
In a meeting with Commission III of the DPR, Nabilah O'Brien expressed special respect for President Prabowo Subianto who always emphasized the importance of legal protection for all Indonesian people. Nabilah said that the incident he experienced had left a deep wound for him because he was named a suspect in defamation, where he was also a victim of theft.
"However, the situation became even more difficult when the incident developed in a much more strange direction until finally I myself had to accept a decision that shook my life, at that time I honestly felt very broken, very sad and confused," said Nabilah.
Nabilah revealed that there were times when she felt that her hopes as a citizen were almost gone. "But today I stand here because the state is present, the Commission III of the DPR RI which has led, accompanied and brought me to this day, for that I express my sincere gratitude to Commission III of the DPR RI and all the leaders of the country who have paid attention to this issue," he said.
"I believe that justice is not something that comes by itself, and we, I personally decided to forgive everything that happened yesterday," added Nabilah.
