Kemnaker Tindak 12 Perusahaan Pelanggar TKA dan Denda Rp4,48 Miliar
JAKARTA - The Ministry of Manpower (Kemnaker) has taken action against 12 companies that were judged to have violated the provisions on the use of Foreign Manpower (TKA) by imposing a total fine of Rp. 4,482,000,000.
This action was carried out throughout January to February 2026 in six provinces, as a step to ensure compliance with labor norms is real in the field and provides certainty for workers and businesses that obey the rules. This fine will later be included in the state treasury as Non-Tax State Revenue (PNBP).
"The amount of fines imposed on each company varies, depending on the number of foreign workers who are judged to have been employed in accordance with the provisions," said Director General of Manpower and Occupational Safety and Health Supervision (Dirjen Binwasnaker and K3) Kemnaker, Ismail Pakaya, through the Press Release of the Public Relations Bureau of Kemnaker, Monday, February 23.
Ismail emphasized that compliance operations with labor norms, especially the use of temporary workers, will continue throughout 2026. According to him, the issue of temporary workers is currently a public concern so it needs to be responded to through rapid, accurate, and measurable supervision so that the implementation of the norm is effective in the workplace.
He explained that the inspection of the company's compliance with the use of temporary workers referred to Government Regulation Number 34 of 2021 concerning the Use of Temporary Workers as well as provisions in the Employment Creation Law. Companies that are still employing temporary workers who do not comply with the provisions are asked to immediately make adjustments.
"If the company does not make adjustments, it will be subject to action in accordance with laws and regulations," said Ismail.
Ismail also opened a public complaint room regarding alleged violations of the norms for the use of temporary workers and the misuse of temporary workers' work permits. Every public report will be evaluated and can be followed up according to the priority scale of supervision.
Meanwhile, the Director of the Labor Standards Inspection Directorate, Rinaldi Umar, explained that the violation of the use of temporary workers was found based on the results of the inspection of the local provincial Labor Inspectorate together with the Labor Inspectorate of the Ministry of Manpower who went directly to the field.
"In addition to the companies that have been fined, there are still several companies in the process of paying and calculating the amount of fines. It is not impossible that the amount of state revenue from this sector will increase," explained Rinaldi.
The twelve companies that were fined were from six provinces, with the largest number of companies in Central Sulawesi. However, the largest fine was imposed on PT BAP from West Kalimantan for Rp2,172,000,000, followed by PT BIS in North Sumatra for Rp972,000,000.
