Not Only HGB, Minister Nusron Ensures that Religious Foundations Can Now Have SHM
JAKARTA - The Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) ensures that religious foundations can have land rights in the form of a Certificate of Ownership (SHM).
This was emphasized by the Minister of ATR/Head of BPN, Nusron Wahid, in a meeting at the Secretariat of the Indonesian Ulema Council (MUI) Banten Province, Friday, February 20, 2026.
"Islamic Foundation which operates in the field of education and social with the applicable regulations is allowed to have ownership. So, now you can have SHM," said Nusron quoted from an official statement, Saturday, February 21, 2026.
Nusron explained that previously religious foundations could only have a Building Use Right (HGB) or SHM in the name of the foundation's manager.
"There is no need to use HGB or deposit assets in the name of the manager, but directly in the name of the foundation as an institution," he said.
Until now, said Nusron, many foundations have chosen to entrust the ownership of land to someone to certify their assets.
However, this has the potential to cause land ownership conflicts in the future.
Through this regulation, pesantren and religious school land can now be recorded directly in the name of the foundation.
Thus, the arrangement of assets can be more orderly, transparent, and sustainable in accordance with land law provisions. The sustainability of educational institutions is also believed to be better maintained in the future.
As part of the implementation of this policy, the Ministry of ATR/BPN has prepared a mechanism for determining religious foundations as legal subjects of ownership rights.
The scheme of the legal subject of the property holder is determined through a request to the Minister of ATR/Head of BPN.
In addition, the application must be accompanied by a recommendation from the Directorate General of Islamic Community Guidance of the Ministry of Religion (Kemenag) so that the process of recording land rights can be carried out legally and integrated.
"Therefore, we give a way out like this. There is a way out, but I see that those who take advantage of it are still not many," he said.
He hopes that religious organizations can immediately utilize this mechanism to organize the assets of pesantren and religious education institutions.
"In this way, related assets can be orderly in terms of administration, have legal certainty and maintain their sustainability for the benefit of the education and social life of the people," he said.
