DPR Rapur Agree that the Constitutional Court Does Not Have the Authority to Process the Report of Adies Kadir Allegedly Violating Ethics
The House of Representatives (DPR) has approved the conclusion of the DPR Commission III meeting that the Constitutional Court (MK) does not have the authority to follow up on reports related to the election process of the former Deputy Speaker of the DPR, Adies Kadir as a candidate for the MK judge proposed by the DPR.
The approval was taken in a plenary meeting (rapur) chaired by the Speaker of the House of Representatives, Puan Maharani at the Parliament Complex, Senayan, Jakarta, Thursday, February 19.
Puan said that the Chairman of the DPR RI had received a letter from the Chairman of Commission III number B-117/PW.01/2/2026 dated February 18, 2026 regarding the submission of the conclusion of the DPR RI Commission III meeting to be read at the plenary meeting.
The conclusion of the meeting of Commission III of the DPR RI is that first, Commission III of the DPR RI confirms that the authority to elect Constitutional Judges by the House of Representatives of the Republic of Indonesia is a constitutional mandate as regulated in Article 24C Paragraph 3 of the 1945 Constitution.
"Therefore, the Constitutional Court Honor Assembly does not have the authority to follow up on reports related to the process of the Constitutional Court election mechanism by all proposing institutions, including that carried out by the Indonesian House of Representatives on behalf of Prof. Dr. Ir. Adies Kadir, S.H., M.Hum," said Puan.
Second, Commission III of the DPR RI asked the Constitutional Court Honor Assembly (MKMK) to remain consistent in carrying out its authority as stipulated in Article 27A of Law Number 7 of 2020 concerning the Constitutional Court which limits the duties of the Constitutional Court Honor Assembly only on the enforcement of the code of ethics and conduct of Constitutional Judges who are in office.
Third, Commission III of the DPR RI recommends to the Constitutional Court to clarify the arrangements regarding the duties, functions, and authority of the Constitutional Court Honor Council to be in accordance with the mandate of Law Number 7 of 2020 concerning the Constitutional Court.
"Furthermore, we ask the honorable council session, whether the conclusion of the DPR Commission III meeting can be approved and followed up according to the applicable mechanism?" asked Puan.
"Agree", exclaimed all members of the plenary meeting.
"Agree?" asked Puan again, followed by a hammer tap of approval.
