MKMK Rampung Minta Keterangan Adies Kadir soal Laporan Dugaan Langgar Etik
JAKARTA - The Constitutional Court Honor Assembly (MKMK) has requested information from Constitutional Judge Adies Kadir as the reported in the report of alleged violations of the code of ethics and conduct of constitutional judges and conflicts of interest.
"Yes, we heard his statement at 08.00-09.00 WIB," said Chairman of the MKMK I Dewa Gede Palguna to ANTARA when contacted from Jakarta, Thursday, quoted by Antara.
However, Palguna could not explain further about the contents of the statement delivered by Adies Kadir and other substances that were investigated by the constitutional judge of the proposed DPR RI.
"I can't tell you what it contains," he said.
After hearing Adies Kadir's statement, the MKMK consisting of three members will hold a meeting of judges (RPH) to determine the continuation of the public report.
"As we explained yesterday in the DPR, we will first RPH the three of us, whether this is worth continuing or not," explained Palguna.
Previously, Palguna emphasized that the report related to Adies Kadir was only at the preliminary examination stage, which means it has not reached the core examination stage. The preliminary examination with the agenda of hearing the report was held on Thursday (12/2).
This was stated by Palguna during a public hearing (RDP) held by Commission III of the Indonesian House of Representatives, Wednesday (18/2), to respond to members of parliament who questioned the authority of the MKMK to examine the validity of Adies Kadir's nomination.
"Please, dong, don't think we have decided. This is only a preliminary examination. The essence of the preliminary examination is later two: one, the trial can continue or it can be immediately decided," he said.
Palguna said that as far as the implementation of the authority of the MKMK and the substance related to the report could not be answered at this time because it concerned the independence of the panel.
He also emphasized that no institution should interfere with the authority of the MKMK, including the constitutional judges who appointed them. This is part of the oath of office that the three members of the MKMK uphold.
He further explained that the public report questioning Adies Kadir's nomination was still registered by the MKMK because the report had met the requirements as stipulated in the procedural law.
"There is also a question, 'When is a request considered to be ineligible?' [The answer] is if the request is not clear. If there is clarity about who the applicant is, who the judge is, what evidence is presented, we have no reason not to register," he said.
It is known that as many as 21 professors, lecturers, and legal practitioners who are members of the Constitutional and Administrative Law Society or CALS reported Constitutional Judge Adies Kadir to the Constitutional Court Honor Council or MKMK.
Adies Kadir was reported because his nomination as a constitutional judge was suspected of violating the code of ethics and conduct guidelines for MK judges as well as laws and regulations. This report is said to be to maintain the integrity and dignity of the Court.
When met after submitting the report at the Constitutional Court Building, Jakarta, Friday (6/2), CALS representative, Yance Arizona, said that his party understood that the MKMK had been examining reports when someone had become a Constitutional Court judge.
However, in this report, the reporters asked the MKMK to expand its jurisdiction, namely to correct the ethical errors in the selection process for judges.
In its report, CALS reasoned that the nomination of Adies Kadir as a constitutional judge to replace Arief Hidayat was inappropriate because it was carried out after Commission III of the Indonesian House of Representatives chose another candidate, namely Inosentius Samsul.
In addition, CALS also considers Adies Kadir, with his background as a politician, to have a great potential for conflict of interest when trying cases, both testing laws and disputes over election results.
Therefore, CALS through its report asked the MKMK to dismiss Adies Kadir from the position of constitutional judge.
