MKD: Tidak Ada Pelanggaran Etik dalam Proses Pemilihan Adies Kadir sebagai Calon Hakim MK Usulan DPR
JAKARTA - The House of Representatives (DPR) Council of Honor Court (MKD) stated that there was no violation of ethics in the selection process of Adies Kadir as a candidate for Constitutional Court (MK) judge proposed by the DPR.
This was stated by the Chairman of the DPR MKD Nazaruddin Dek Gam when reading the verdict on the case without complaint against the former Deputy Speaker of the DPR Adies Kadir at the DPR building, Senayan, Jakarta, Wednesday, February 18.
Nazaruddin explained that the process of eligibility testing for Constitutional Court judges carried out by Commission III of the DPR against Adies Kadir, began with a notification letter from Innosentius Samsul as a candidate for Constitutional Court judge who was selected based on the DPR plenary meeting on August 21, 2025, received another assignment.
Then on January 26, 2026, Commission III of the DPR conducted a suitability and eligibility test for Adies Kadir and was approved by acclamation as a candidate for Constitutional Court judge from the DPR element.
"I repeat, by acclamation, I approve of Professor Doctor Engineer Adies Kadir, S.H., M.Hum as a candidate for Constitutional Justice proposed by the DPR RI institution," said Nazaruddin.
Furthermore, on January 27, 2026, continued Nazaruddin, the plenary session of the DPR RI by acclamation approved Adies Kadir as the candidate for Constitutional Judge proposed by the DPR RI institution. "Then there is a group that questions the legality of the election of Prof. Dr. Ir. Haji Adies Kadir, S.H., M.Hum as the candidate for Constitutional Judge proposed by the DPR RI institution," he said.
Therefore, Nazaruddin said the MKD felt it was necessary to examine whether the election of Adies Kadir as a candidate for Constitutional Justice proposed by the DPR RI institution had met the provisions of the legislation.
After conducting a study and searching for data on the candidacy of Adies Kadir which has become a public concern, continued Nazaruddin, the Court of Honor of the Council has several considerations. P
First, the suitability and eligibility test process for Constitutional Court Judge Adies Kadir was carried out after a notification to Commission III of the DPR Innosentius Samsul was given another assignment.
"Remember, after the notification that Innosentius Samsul received, I repeat, received another assignment and therefore cannot continue as a candidate for Constitutional Justice proposed by the DPR RI institution," he said.
Third, the process of selecting Adies Kadir as a candidate for Constitutional Justice proposed by the DPR institution has fulfilled the provisions of the legislation, namely Article 185 of the MPR, DPR, DPD, and DPRD Law which regulates the DPR to give approval or consideration to candidates to fill a position based on the provisions of the legislation through the DPR plenary meeting, as well as Article 25 of the DPR Constitution which regulates the election is carried out through administrative research, eligibility test, determination of the order of candidates, and notification to the public through print media or electronic media.
"Fourth, that Professor Doctor Engineer Adies Kadir, S.H., M.Hum is qualified as a Constitutional Justice as regulated in Article 15 paragraph 2 of the Constitutional Court Law," said Nazaruddin.
Fifth, because the manner and conditions for the election of Adies Kadir as a candidate for Constitutional Justice proposed by the DPR institution are in accordance with laws and regulations, there is no violation of the DPR code of ethics in the process.
"With this, the Honorable Court of the Council decides and judges as follows. First, there was no violation of ethics in the process of compliance and eligibility tests and the election of Professor Doctor of Engineering Haji Adies Kadir, S.H., M.Hum as a candidate for Constitutional Court judge from the element of the DPR by Commission III of the DPR RI which was strengthened in the plenary session of the DPR RI," said Nazaruddin.
"Second, test the suitability and eligibility for the nomination of Professor Doctor Engineer Adies Kadir, S.H., M.Hum as a candidate for Constitutional Court judge from the elements of the DPR RI in accordance with the People's Consultative Assembly Law, the House of Representatives, as well as the Regional Representative Council and the Regional Representative Council, as well as the DPR Regulation which regulates the rules of procedure and code of ethics," he concluded.
