Manding Forum Asks for the Value of Administrative Fines for Kiki Barki Group's Affiliates

JAKARTA - The Manding Forum questions the value of the fine of the Kiki Barki business group's children (PT Harum Energy), PT Mahakam Sumber Jaya (PT Mahakam) which is considered too small when compared to the land area and operational period of the company.

According to the Manding Forum, the fine of only IDR 13.2 billion is not worth the area of PT Mahakam's land which is the object of a fine of 116.9 hectares in Makarti Village, Kutai Kartanegara.

"Yes, it's not worth it, it's too small. The land area is 116.9 hectares, the fine value is only IDR 13.2 billion. Even though the fine value of the PKH Task Force has been regulated in the Presidential Decree, namely the Area of Violation multiplied by the Time Period and then multiplied again by the Fine Rate (D = Area x J x TD). What's going on? Is there a third party who plays 'arranging' the size of this fine," said Coordinator of the Manding Forum, Andi Ahmad Gufran in a statement to the media, Monday, February 9, afternoon.

Referring to the data, with the land area of PT Mahakam, the value of the fine that must be paid by the company should have amounted to hundreds of billions of rupiah. Because, the operationalization of PT Mahakam has been going on since 2004 or about 21 years ago. Thus, said Andi, on the fine that has been paid, PT Mahakan's payment shortfall is still very large.

"Yes, it is still lacking. The fine should amount to around Rp. 800 billion. The amount of the shortfall is quite large to increase state revenues. This must be billed again," he explained.

The Manding Forum also asked the PKH Task Force not to hesitate to recover the estimated shortfall. The PKH Task Force must not be discriminatory in imposing administrative fines imposed on these companies. Andi even added that the PKH Task Force should not be afraid to fight against any oligarchy or magnate behind the illegal mines.

"Try to calculate it again. If it is less, it will be billed again. The PKH Task Force must not retreat. Salim Group, BGA Group, Sampoerna Agro Group, Astra Agro Lestari were all fined by the PKH Task Force. The same should apply to Kiki Barki's business group," he said.

Meanwhile, Andi admitted that he would continue to support the steps of the Forest Area Control Task Force (Satgas PKH) to regulate illegal activities in all forest areas. The Manding Forum said that this step was proof of the state's strength against illegal mining crime activities.

"Yes, it must be like that. The state must not lose to them. The people certainly support the firm steps of the PKH Task Force," he said.
