At the trial, it was revealed that Brigadier Rizka stepped on Brigadier Esco while sleeping, stabbing his ear with scissors
JAKARTA - Brigadier Rizka Sintiani was revealed to have carried out a series of acts of persecution against Brigadier Esco FaskaRely, resulting in her husband's death with scars all over his body.
The actions of the West Lombok Police members were revealed from the indictment read by the public prosecutor in the first trial held by I Putu Suyoga as the chairman of the panel of judges at the Mataram District Court, Tuesday, February 10.
"When the victim woke up from sleep at 20.39 Wita, the defendant entered the room and immediately stepped on the victim's stomach until he fell to the floor," said Muthmainnah representing the public prosecutor's team reading the indictment of Brigadier General Rizka, reported by ANTARA.
From the first persecution, the victim, without resisting, was again subjected to persecution by his wife.
"The defendant then kicked the victim's left hip several times and hit the victim's face several times," said the prosecutor.
After the beating, Ni Made Saptini who continued to read the indictment said the defendant paused for a few seconds, then continued the persecution by taking scissors and stabbing the victim's left leg three times.
"The victim tried to ward off the defendant's attack, but in a sleeping position (lying on the bed), the defendant stabbed the victim's right leg, calf and right foot with scissors," said Made Saptini.
The act of persecution continued by stabbing the victim's face three times using scissors. However, the defendant's actions were successfully chased away by the victim.
"The victim had to dodge so that the victim's left ear was hit and stabbed the right ear. The defendant hit the victim's head with a blunt object while the victim was in a prone position," said the prosecutor.
A short while after the defendant abused the victim, the first child aged 6 years from the couple of police officers saw his biological father in the room already in a state of not moving.
The position of the defendant at that time was mentioned in the indictment to collect witnesses, namely Saiun, Nuraini, Paozi, and Dani who also had the status of a suspect in a separate case file, in the victim's child's room.
Then, the victim who was already in a motionless condition was said by the prosecutor to be picked up by the four witnesses to the victim's child's room.
The prosecutor's accusation also stopped there. The whereabouts of the victim's body, which was first found with his neck entangled in a rope on a small tree in an empty garden behind the house, was not included in the prosecutor's indictment.
However, the prosecutor at the end of the indictment read the applied article. For Brigadier Rizka, the prosecutor applied Article 44 paragraph (3) of Law Number 23 of 2004 concerning the Elimination of Violence in the Family (PKDRT) and/or Article 459 in conjunction with Article 20 letter c of Law Number 1 of 2023 concerning the Criminal Code and/or Article 338 of the Criminal Code.
Meanwhile, for the other four defendants in a separate case, namely Saiun, Nuraini, Paozi, and Dani, Article 459 and/or Article 458 paragraph (1) and/or Article 270 in conjunction with Article 20 letter c of Law Number 1 of 2023 concerning the Criminal Code.
