Two Students of Kadindik extortion in East Java are sentenced to 1.5 years in prison
Two students from Surabaya, Sholihuddin and M. Syaefiddin Suryanto, were sentenced to 1 year and 6 months in prison in the case of alleged extortion against the Head of the Education Service (Kadindik) of East Java, Aries Agung Paewai, at the Surabaya District Court (PN).
The East Java High Prosecutor's Office (JPU), Sri Rahayu, assessed that the actions of the defendants had injured the good name and honor of Aries Agung Paewai as a public official.
"The defendants were proven to have legally and convincingly committed the crime of extortion as stipulated in Article 433 paragraph (2) jo Article 612 of Law Number 1 of 2023 concerning the Criminal Code jo the 2026 criminal adjustment regulation," said the JPU in the trial reported by ANTARA, Monday, February 9.
In the prosecutor's consideration, the aggravating factor is that the defendants' actions are considered to have tarnished the reputation and dignity of the victim as a state official.
Meanwhile, the mitigating factor is that the two defendants have never been convicted and have been cooperative during the trial process.
Responding to the demands, the legal advisor of the two defendants, Faisol, stated that he would submit a written defense note (pledoi) at the next hearing according to the schedule of the panel of judges.
Previously, the two were charged with extorting Rp20 million from the victim with the threat of demonstration and dissemination of issues of infidelity and alleged corruption.
For his actions, the JPU framed the two defendants with the first alternative charge using Article 368 paragraph (1) of the Criminal Code regarding extortion with the threat of violence.
In addition, he was also charged with Article 369 paragraph (1) of the Criminal Code regarding the threat of defamation, as well as Article 310 paragraph (1) and (2) of the Criminal Code regarding defamation orally and in writing, in conjunction with Article 55 paragraph (1) of the Criminal Code. 1.
