MK's decision on the College, Professor of Medicine asks the Ministry of Health to reorganize the Ministry of Health's establishment
JAKARTA - The Indonesian Medical Professors Assembly (MGBKI) together with three professional and academic organizations urged the Ministry of Health (Kemenkes) to rearrange the institutions formed based on the authority of the Minister of Health.
This step is considered as a consequence of the Constitutional Court (MK) Decision Number 111/PUU-XXII/2024 and 182/PUU-XXII/2024 which confirms the limitation of the Minister of Health's authority in the formation and management of medical and health colleges.
MGBKI Chairman Budi Iman Santoso said the college is an independent scientific entity formed by the academic and professional community, not by the government.
Therefore, the formation of a college by the Minister of Health is considered contrary to the 1945 Constitution.
"The MK has emphasized that the role of the Minister of Health is administrative, not substantive. All instruments that exceed the authority need to be rearranged," he said.
Apart from the college, other institutions that are asked to be reviewed include the Indonesian Medical Council (KKI) and the Professional Disciplinary Council.
According to MGBKI, certainty about the roles and functions of these institutions is important to maintain the quality of medical education and professional discipline.
The Coordinator of the Indonesian Health Resilience Alliance, Baharuddin, assessed that excessive policy interventions risked lowering the quality of health services.
"Stability of governance will have an impact on the sustainability of the national health system," he said.
