Arief Hidayat Resmi Purnabakti sebagai Hakim MK, Bakal Digantikan Adies Kadir
JAKARTA - The Constitutional Court respectfully dismissed Constitutional Judge Arief Hidayat who entered retirement during the graduation ceremony for post-service at the Constitutional Court (MK) Plenary Session I building, Jakarta.
In the post-graduation ceremony, the Secretary General of the Constitutional Court, Heru Setiawan, read a passage from the Presidential Decree of the Republic of Indonesia Number 9/B of 2026 concerning the Dismissal and Appointment of Constitutional Judges submitted by the House of Representatives of the Republic of Indonesia (DPR RI).
"Deciding, determining and so on, to one, respectfully dismissing Prof. Dr. Arief Hidayat S.H., M.S. as a Constitutional Judge effective February 3, 2026, accompanied by words of thanks for his dedication and services during his tenure," said Heru as reported by ANTARA, Wednesday, February 4.
Meanwhile, the Constitutional Court Chief Justice Suhartoyo gave the impression of a message in Arief's release who had been with him for 13 years at the Constitutional Court.
"We can be together together in this room in good condition and in good health in order to release the noble Prof. Arief and his wife who have been with us all for 13 years," he said.
Suhartoyo revealed that he had worked with Arief for 11 years at the Constitutional Court. During his tenure at the Constitutional Court, Suhartoyo said that Arief in his retirement did not lose energy and spirit at the end of his term.
"I am surprised by Prof. Arief with his consistency and kindness because in my imagination Prof. Arief and Mr. and Mrs. Judges and all friends, when someone wants to enter at the end or end of his term of office, it is like losing energy and spirit. Nah, it turns out that it does not apply to the noble Prof. Arief," he said.
In addition, Suhartoyo revealed that Arief is someone who has a high flying time in the legal world. The flying hours, said Suhartoyo, are very felt when Arief is on duty to pay attention to every detail of the legal case.
"The finalization forum at the Meeting of Judges (RPH) is up to a coma point, it is questioned, debated, and may even be the beginning of a discussion that then leads to a hard point, hard in a positive sense," he said.
For information, Arief will retire on February 3, 2026 or will be 70 years old.
The honorable dismissal by the Constitutional Court in accordance with the retirement provisions stated in Article 23 of Law Number 7 of 2020, the Constitutional Court regulates that the position of constitutional judges is dismissed with honor because they have reached the age of 70.
The Constitutional Court, in accordance with Constitutional Court Regulation Number 4 of 2012, is required to inform the proposing institution no later than six months before the judge reaches the age of 70 or retires during his term of office.
For this reason, the DPR in a plenary meeting on Tuesday (27/1) appointed Adies Kadir as Constitutional Justice to replace Arief's position.
