Meet the PT Pakerin Labor Union, Director General of AHU Guarantees to Do the Best for Both Parties
JAKARTA - The Director General of General Legal Administration (Dirjen AHU) of the Ministry of Law (Kemenkum) Widodo again met with the Workers' Union of PT. Paper Factory Indonesia (Pakerin).
Accompanied by the Director of the Business Agency, Andi Taletting Langi and the Secretary of the Directorate General of General Legal Administration (SesDitjen AHU) Andi Yulia Hertaty, Widodo listened to the chronology and received the aspirations conveyed by the PT Pakerin workers' union, including the unpaid salaries of employees for the last 4 (four) months.
"They demand the rights of employees who have not been paid by the Company due to ownership disputes and the cessation of PT PAKERIN's operations due to legal disputes between owners, which have an impact on the unpaid salaries of employees," said Widodo.
The Director General of AHU said the demonstration carried out by PT Pakerin workers was a family conflict and had no direct relationship with the Ministry of Law.
"'This is a family conflict, because they came here we tried to mediate, but we made sure that this action had nothing to do with the Ministry of Law and Human Rights directly," he added.
This action is the umpteenth action held by PT Pakerein workers.
Previously, the Workers' Union asked the Minister of Law through the Director General of AHU to revise the Decree Number AHU-38.AH.01.41 of 2024 and open the blocking of access to the PT Pabrik Kertas Indonesia (PAKERIN) Legal Entity Administration System (SABH).
The reason is, by revising the Decree, it can help save the mass layoffs plan and help operationalize PT. Paper Factory Indonesia.
"The beginning of this conflict was a family dispute over the ownership of the company between David Siemens, Njoo Steven and Njoo Hendry, so it has nothing to do with the Ministry of Law and Human Rights," continued Widodo.
He emphasized that this dispute has entered the realm of the court, but the Ministry of Law is trying to mediate as an alternative step in the process of resolving problems by prioritizing the principle of kinship.
"We have conducted a mediation process by presenting the three parties in dispute, but until now there has been no consensus between the three," he said.
In addition, the Director General of AHU emphasized that the government through the Ministry of Law and Human Rights would continue to encourage the resolution of this problem thoroughly and accepted by all parties, so that employees are not affected by the dispute that occurred.
Efforts to bring together the parties to the dispute will continue to be carried out by involving all stakeholders so that the resolution of the problem can be decided together.
"We can convey that currently the Decree is being tested in court and is the object of a lawsuit at the cassation stage so that to uphold the ongoing legal process, we are still considering it," he said.
The Director General of AHU explained that the opening of the blocking on the access to the Legal Entity Administration System (SABH) of PT. Indonesian Paper Factory (PAKERIN) can be carried out after meeting the provisions of the Minister's Regulation regarding the Blocking and/or Opening of the Blocking of the Limited Company's SABH.
"We will examine to what extent the Ministry of Law and Human Rights through the Directorate General of AHU can meet the aspirations conveyed, given that there is a legal process in court that is ongoing and we also demand that the parties to the dispute to be responsible for fulfilling the rights of employees who have not been paid due to this dispute," he concluded.
