Attorney General's Office Acknowledges Implementation of New Criminal Code and Criminal Procedure Code Takes Time for Adjustment
JAKARTA - The Attorney General's Office (Kejagung) emphasized that the implementation of the new Criminal Code (KUHP) and the Code of Criminal Procedure (KUHAP) requires adjustment time. However, the Adhyaksa Corps ensures its commitment to optimally implement the new legal provisions.
Head of the Legal Information Center (Kapuspenkum) of the Attorney General's Office, Anang Supriatna, said that in practice the implementation of the Criminal Code and the Criminal Procedure Code is not free from various challenges. Therefore, it is necessary to gradually improve and adjust.
"This of course requires time, refinement, and input. In practice there are certainly difficulties and adjustments," said Anang at the Attorney General's Office, Jakarta, Thursday, January 8.
To equalize the perception between law enforcement officers, the Attorney General's Office has signed a memorandum of understanding (MoU) with the National Police. In addition, the Attorney General's Office also carries out socialization and consolidation with regional governments regarding the implementation of the new Criminal Code and Criminal Procedure Code.
Anang emphasized that every input from the public and law enforcement regarding the implementation of the new rules would be collected as material for evaluation and revision in the future. He also admitted that there were significant differences between the old and new KUHAP. "It certainly takes time for adjustment in the beginning," he said.
One of the important differences highlighted is the increasing role of the public prosecutor in coordinating with investigators from the beginning of the case handling. This step is expected to prevent case files going back and forth between investigators and prosecutors.
"Prosecutors must be more proactive in meeting directly before the case is raised so that there is no back and forth on the file. If in the past it could be P18-P19 repeated, now since the beginning of the SPDP it must be immediate," explained Anang.
Regarding the implementation of the new KUHAP, Anang admitted that there were still a number of technical obstacles in the field. However, he emphasized that this would not hinder the performance of the Attorney General's Office in enforcing the law.
"In practice, there are indeed some obstacles that make it difficult, but that is not an obstacle to carrying out the procedural law. It is actually an input for improvement in the future," he concluded.
