JAKARTA - The Chairman of Commission III of the Indonesian House of Representatives, Habiburokhman, welcomed the enactment of the Criminal Code and the Code of Criminal Procedure starting from Friday, January 2. He also congratulated the Indonesian people for having a new legal umbrella.
"Regarding the implementation of the new Criminal Code and Criminal Procedure Code, we welcome it with grief and joy. Our long struggle to replace the Dutch colonial legacy of the Criminal Code and the new order legacy of the Criminal Procedure Code can finally be implemented after 29 years of reform," said Habiburokhman in his statement, quoted Saturday, January 3.
A total of 25 government regulations, 1 presidential regulation, and several other derivative regulations have also been prepared. In addition, the principle of non-retroactivity is also applied, namely cases before January 2, 2026 will use the old provisions, while those after it are subject to the new Criminal Code and Criminal Procedure Code.
According to Habiburokhman, with the enactment of the new Criminal Code and Criminal Procedure Code, the Indonesian nation is now entering a new phase, no longer as a repressive apparatus of power but as a tool for the people to seek justice.
"We should have implemented the reform of the Criminal Code and the Criminal Procedure Code at the beginning of the reform, but there are always obstacles and obstacles," he said.
The Gerindra legislator from the DKI Jakarta District also assessed that the Criminal Code and the Criminal Procedure Code would only be very useful for public justice.
