Danki A Yonif 834 Lettu Faisal Divonis 8 Tahun Penjara Kasus Penganiayaan Prada Lucky
KUPANG - The commander of Company (Danki) A Yonif TP 834/WM Lettu Inf Ahmad Faisal, the defendant in the case of abuse leading to the death of Prada Lucky Namo, was sentenced to 8 years in prison with an additional penalty in the form of dismissal from the TNI Army military service.
"The defendant was proven to have legally and convincingly committed a military crime in service by deliberately beating a subordinate or in another way hurting him and causing death, which was carried out together," said the Chairman of the Panel of Judges Major Chk Subiyanto at the continuation of the Prada Lucky case with the agenda of reading the verdict on case number 40-K/PM.III-15/AD/X/2025 with the defendant Danki A Yonif TP 834/WM Lettu Inf Ahmad Faisal at the Military Court III-15 Kupang, East Nusa Tenggara, Wednesday, December 31 reported by ANTARA.
The panel of judges in the verdict sentenced the defendant, Lettu Faisal, to 8 years in prison, minus the temporary detention period, and imposed an additional penalty of dismissal from military service.
The panel of judges also ordered the defendant to pay restitution to the family of the deceased Prada Lucky Namo in the amount of IDR 561 million.
The panel of judges referred to paragraph 1 in conjunction with paragraph 3 of the Military Criminal Law (KUHPM) in conjunction with paragraph 55 paragraph 1-1 of the Criminal Code (KUHP), which regulates the persecution by the military against subordinates.
The verdict was lighter than the Military Audit's demand for the defendant to be sentenced to 12 years in prison on the main offense, reduced by the temporary detention period and additional punishment in the form of dismissal from military service, as well as a restitution penalty of Rp. 561 million.
Previously, a verdict hearing was held for Case No. 42-K/PM.III-15/AD/X/2025 with four defendants, namely Sertu Thomas Desamberis Awi, Sertu Andre Mahoklory, Pratu Poncianus Allan Dadi, and Pratu Rofinus Sale.
The four defendants were sentenced to 6 years and 6 months in prison each, accompanied by an additional penalty of dismissal from military service.
The panel of judges also ordered the defendants to pay restitution to the families of the deceased Prada Lucky Namo, each of whom was Rp136 million more.
This verdict is slightly higher than the Military Audit's demand in the previous trial which demanded the defendants 6 years in prison on the main sentence reduced by the temporary detention period, and the additional penalty of dismissal from military service and a restitution penalty of more than IDR 544 million, so that each defendant was charged with more than IDR 136 million.
The panel of judges added the sentence because the four defendants committed the crime in a drunken state and their actions on the second day or the day after the 17 defendants abused the victim, thus contributing more to the cause of the victim's death.
On the same day, a verdict was also held for case 41-K/PM.III-15/AD/X/2025 with 17 defendants, namely Sertu Thomas Desamberis Awi, Sertu Andre Mahoklory, Pratu Poncianus Allan Dadi, Pratu Abner Yeterson Nubatonis, Sertu Rivaldo De Alexando Kase, Pratu Imanuel Nimrot Laubora, Pratu Dervinti Arjuna Putra Bessie, Letda Inf. Made Juni Arta Dana, Pratu Rofinus Sale, Pratu Emanuel Joko Huki, Pratu Ariyanto Asa, Pratu Jamal Bantal, Pratu Yohanes Viani Ili, Serda Mario Paskalis Gomang, Pratu Firdaus, Letda Inf. Achmad Thariq Al Qindi Singajuru, and Pratu Yulianus Rivaldy Ola Baga.
The panel of judges in the verdict sentenced defendants 1 to 7 and defendants 9 to 15 and 17 (officers and non-commissioned officers) in the main sentence to 6 years in prison, minus the temporary detention period, and imposed an additional sentence of dismissal from military service.
Meanwhile, defendants 8 and 16 (officers) in the main case were imprisoned for 9 years, reduced by the period of temporary detention, and imposed an additional sentence of dismissal from military service.
The two officers, namely Letda Inf. Made Juni Arta Dana and Letda Inf. Achmad Thariq Al Qindi Singajuru, are both platoon commanders.
The panel of judges also ordered the defendants to pay restitution to the families of the deceased Prada Lucky Namo, each of whom was Rp32 million more.
The panel of judges requires the defendants to pay restitution within 30 days of the final and binding decision.
If it is not paid, the Military Audit ordered the defendants to carry out the restitution at the latest 14 days after receiving the order.
If within the specified time it is not carried out, the Military Audit will confiscate the assets of the defendants to meet the restitution, and if the assets of the defendants are insufficient for the payment of restitution, they will be replaced with imprisonment.
The Chairman of the Panel of Judges, Major Chk Subiyanto, had asked the defendants again to clarify the judgment and the defendants were asked to consult with their legal advisers.
After arguing with the legal advisor, the defendant stated that he thought about it. The Military Audit also stated the same thing. The thinking time is 14 days to appeal or accept the verdict.
In the trial, Major Subiyanto was accompanied by two members of the panel of judges, Captain Chk Denis C. Napitupulu, and Captain Chk Zainal Arifin A. Yulianto.
Meanwhile, the defendants' legal advisers, namely Major Chk Gatot Subur and Letda Chk Benny Suhendra Las Baun. Meanwhile, the Military Auditor is Lieutenant Colonel Chk Yusdiharto, Lieutenant Colonel Chk Alex Pandjaitan and Major Chk Wasinton Marpaung.
The case of alleged severe persecution that resulted in the death of Prada Lucky Namo involved 22 defendants packaged in three Investigation Reports (BAP), namely the BAP of one defendant (Danki A), BAP 17 defendants, and BAP of four defendants.
Prada Lucky was abused by his seniors at the 834/Wakanga Mere Territorial Development Battalion in Nagekeo Regency, East Nusa Tenggara (NTT) with the pretext of training. He was treated at the health center and then referred to the hospital until he breathed his last on August 6, 2025.
Meanwhile, the pattern of harsh training that resulted in the death of the victim was said to be related to allegations of sexual deviation (LGBT) involving Prada Lucky and Prada Richard.
