Mensesneg Says Prabowo Has Signed the New KUHAP, Applies Together with the Criminal Code in January 2026

JAKARTA - Secretary of State (Mensesneg) Prasetyo Hadi confirmed that President Prabowo Subianto had signed the new Criminal Procedure Code (KUHAP) after it was passed by the DPR.

"Yes," said Prasetyo when asked by reporters at Halim Perdanakusumah, Jakarta, Monday, December 29. When asked about the time of the signing, he admitted that he did not remember the exact date, but confirmed that it was carried out in mid-December. "Yes," he said.

Prasetyo also said that the KUHAP had officially become a law. When asked if the policy had a number as a law, he answered briefly, "Yes."

The most important point, Prasetyo emphasized, was that the implementation of the KUHAP would coincide with the national Criminal Code in January 2026. "Yes, dong," he said. When the question was repeated to confirm the intention of simultaneous implementation, Prasetyo again emphasized, "Yes."

Previously, the DPR approved the KUHAP bill into law in the plenary session on Tuesday, November 18, 2025, after the Speaker of the DPR Puan Maharani asked for approval and was answered in the affirmative by all members present. Chairman of Commission III of the DPR Habiburokhman stated that the KUHAP had just been prepared to accompany the implementation of the national Criminal Code (Law No. 1 of 2023) which is scheduled to take effect on January 2, 2026.

The discussion of the KUHAP bill lasted more than a year since November 6, 2024, with public participation. This policy contains a number of important changes, ranging from strengthening human rights protection, digitization of legal processes, supervision of forced efforts, to synchronization of procedural law with the national Criminal Code.
