The Prosecutor Submits Cassation To Free Sentence Of Father And Uncle Of The Accused Child Rapist In Aceh

BANDA ACEH - The Public Prosecutor (JPU) Attorney General Aceh Besar, Aceh, filed an appeal regarding the acquittal of two defendants of rape of a minor to the Supreme Court (MA).

"The two defendants are the father and uncle of the victim. We have submitted an appeal with the accused, the father of the victim. While the defendant is the victim's uncle, we are currently compiling his cassation memory," said Prosecutor Prosecutor Aceh Besar Muhadir as quoted by Antara, Thursday, May 27.

Previously, the defendant who was the father of the victim with the initials MA was acquitted of the Janntho Sharia Court, Aceh Besar. Meanwhile, the accused's uncle of the victim with the initials DP was found guilty by the Jantho Sharia Court panel of judges with a sentence of 200 months in prison or 16 years and six months. However, at the appeal level, the defendant was acquitted.

Muhadir said that the accused's father had been appealed to the Supreme Court in March 2021 or seven days after receiving the acquittal of the Syar'iyah Jantho Court.

As for the accused, the victim's uncle, namely DP, said Muhadir, his cassation memorandum was being compiled.

"We are currently preparing to prepare a cassation memory, because we just received the verdict on Tuesday (25/5) yesterday. We will submit it until next Tuesday," he said.

Muhadir said, in the cassation material, his party questioned whether a legal rule was not properly stipulated or implemented by the judge regarding the verdict of the case.

"Whether the method of judging is not carried out according to the provisions of the law, and is it true that it has exceeded its authority," he said.

During the trial of this case, the victim became a witness twice, first as a witness to the prosecutor, and then at the last trial was brought by a lawyer as a witness of the defendant.

"The judge decided yesterday's case from the evidence presented by the lawyer, our evidence was not considered," said Muhadir.
