Judge Called Prosecutor's Demand Too Heavy, Says Rizieq Shihab Not Inciting
JAKARTA - The panel of judges said that the demands of the public prosecutor (JPU) against Rizieq Shihab and five former FPI officials in cases of violating the health protocol (prokes) were too high. Because the prosecutor's demands are considered based on the first indictment.
"The panel of judges is of the opinion that the criminal charges, if considering the actions and mistakes of the defendants, are considered a bit heavy for the defendants because it turns out that the prosecutor based their demands on the first indictment on Article 160 of the Criminal Code," said presiding judge Suparman Nyompa during a trial at the East Jakarta District Court, Thursday, May 27th.
It's just that, during the trial process, continued Suparman, the first dakwan was not proven. There was no incitement by the defendants and so on.
"But according to the facts of the trial, the defendant did not commit incitement or violence against the general authorities," said Suparman.
However, based on the results of the trial the defendants violated the third charge regarding health quarantine. Thus, they must be given criminal sanctions.
"The defendant was only found guilty of not being criminalized in the third indictment Oasal 93 of the Law of the Republic of Indonesia Number 6 of 2018 concerning Health Quarantine in conjunction with Article 55 paragraph (1) 1 of the Criminal Code carries a criminal sentence of 1 year imprisonment and / or a criminal density of up to IDR 100 million, "said Suparman.
Previously, the panel of judges at the East Jakarta District Court found Rizieq Shihab and five former officials of the Islamic Defenders Front (FPI), namely, Haris Ubaidillah, Ahamd Sabri Lubis, Ali Alwi Alatas, Idrus Al-Habsyi, Maman Suryadi, guilty of violating health protocols (prokes). ) in Petamburan. They were sentenced to 8 months in prison.
The verdict was much lower than the prosecutor charged. This is because previously Rizieq Shihab was demanded 2 years in prison. Meanwhile, for Haris Ubaidillah, Ahamd Sabri Lubis, Ali Alwi Alatas, Idrus Al-Habsyi, Maman Suryadi were sentenced to imprisonment for 1 year and 6 months.
