Government Prepares PP to Regulate the Implementation of the Police Law and the ASN Law after the Supreme Court Decision
JAKARTA - The government has decided to draft a Government Regulation (PP) to regulate the implementation of the Police Law and the State Civil Service Law (ASN). This was done following the decision of the Constitutional Court (MK) which removed the phrase of assigning members of the National Police. This step was taken to respond to the widespread polemics in the community.
Coordinating Minister for Legal, Human Rights, Immigration, and Corrections, Yusril Ihza Mahendra, said the controversy arose after the Constitutional Court's decision and the issuance of Police Regulation Number 10.
According to him, a solution is needed that has a wider reach and binds all ministries and institutions.
Yusril emphasized that the regulation through the Regulation of the National Police Chief had limitations because it only applied internally in the National Police. Meanwhile, the issue of assignment and double posts of members of the National Police is directly related to the provisions in the ASN Law and the Police Law.
"Because it concerns ministries and agencies as well as the implementation of the ASN Law and the Police Law, it must be regulated in the form of a Government Regulation," said Yusril, at the Kartikni Hall, South Jakarta, Saturday, December 20, 2025.
He said that the option to change the Police Law was also open. However, the process takes time because the National Police Reform Acceleration Commission is still carrying out its duties and collecting various inputs from the public.
Therefore, the government considers the preparation of the PP to be the most urgent step to immediately provide legal certainty. The PP will be the basis for implementing the Police Law and the ASN Law after the Constitutional Court's decision.
"Insyaallah it will be developed and the PANRB Ministry and the State Secretariat Ministry have also prepared the initial draft of this RPP, which will be coordinated by the Coordinating Ministry for Legal, Human Rights, Immigration, and Corrections and also by the Ministry of Law," he said.
On the same occasion, the Chairman of the National Police Reform Acceleration Commission, Prof. Jimly Asshiddiqie, said that the PP is expected to be a temporary solution to various problems, including the issue of double posts of members of the National Police which has caused public concern.
"Hopefully in a short time, say in January, the Government Regulation that will provide solutions to the various problems regarding the issue of double posts and others," said Jimly.
According to Jimly, the National Police Reform Acceleration Commission has received more than 100 community groups and more than 300 written inputs related to police reform. He assessed that this showed the public's great attention to the National Police institution.
He added that police reform is the gateway to a broader reform of all law enforcement agencies. However, the most realistic initial step at this time is to solve the problem through a Government Regulation.
"It will soon be designed by the PANRB Ministry, as well as the Ministry of Law, we will help that as the Commission for Acceleration of Reform and even from the Coordinating Minister, all related institutions will collaborate," explained Jimly.
Meanwhile, the National Police Chief, General (Pol), Listyo Sigit Prabowo, emphasized his institution's commitment to obey the law and respect the Supreme Court's Decision Number 114 which removed the phrase of assignment from the Police. He stated that the Police intended to carry out every applicable legal provision.
"Of course, our intention is that as an institution that obeys and respects the Supreme Court's decision, there needs to be an arrangement regarding what is meant, so that we then drafted the Perpol earlier," he said.
"We start with consultations with relevant parties, so that later our steps we hope will not be problematic," he continued.
Listyo emphasized that the National Police would respect and implement all provisions that would later be determined in the PP or if it was further regulated through a revision of the Police Law.
