3 Accused of Corruption in Lhokseumawe Aceh Rusunawa Sentenced to 18 Months in Prison

BANDA ACEH - The public prosecutor of the Lhokseumawe District Attorney's Office (Kejari), Aceh, has demanded three defendants for corruption in the construction of student housing (rusunawa) with a sentence of one year and six months or 18 months in prison.

The demands were read by Public Prosecutor (JPU) Edwardo during the trial at the Corruption Crime Court at the Banda Aceh District Court in Banda Aceh, Friday, December 19.

The three defendants are Bambang Prayetno as the official who signed the payment order (SPM) for the construction of the Lhokseumawe Polytechnic dormitory at the Regional Housing Provision Implementation Office I Sumatra.

Then the defendant Haryanto as the Director of PT Sumber Alam Sejahtera, the winning company for the tender for the construction of apartment houses and Aulia Rizky as the company's borrower and executor.

In addition to imprisonment, the JPU also demanded that the three defendants pay a fine of Rp. 50 million each with a subsidy or substitute punishment if they do not pay three months in prison.

For the defendant Aulia Rizky, the JPU also demanded an additional punishment of paying compensation to the state in the amount of IDR 648 million. If the defendant does not pay, he will be sentenced to one year in prison.

The JPU also demanded that the defendant Haryanto be sentenced to an additional penalty of paying Rp250 million in state compensation. If the defendant does not pay, he will be sentenced to one year in prison.

The JPU stated that the defendant was proven to be legally and convincingly guilty of violating Article 3 jo Article 18 Paragraph (1) letter b of Law Number 31 of 1999 as amended by Law Number 20 of 2001 jo Article 55 Paragraph (1) ke-1 jo 64 of the Criminal Code.

In his demand, the JPU stated that the Regional Housing Provision Implementation Office I of Sumatra at the Directorate General of Housing of the Ministry of PUPR managed a budget of Rp. 14 billion sourced from the 2021 and 2022 State Budgets for the construction of student apartments at the Lhokseumawe Polytechnic.

The construction of the rusunawa was carried out by PT Sumber Alam Sejahtera. However, in the implementation, the construction was only about 90 percent. Based on expert calculations, the value of the building only reached Rp10 billion from the contract.

"Meanwhile, the disbursement of funds was carried out to reach Rp. 12 billion. Based on the results of the calculation, the state losses incurred in the construction of the rusunawa reached Rp. 928.28 million," said the JPU.

The panel of judges headed by Irwandi continued the trial next week with the agenda of listening to the defense of the defendants.
