Provincial Government-Kaltara Provincial Government Signs MoU on Social Work, Support Implementation of the 2026 National Criminal Code
TANJUNG SELOR - The North Kalimantan Provincial Government (Pemprov) together with the High Prosecutor's Office (Kejati) of North Kalimantan signed a Memorandum of Understanding (MoU) on the implementation of social work criminal sanctions, in line with the coming into force of the National Criminal Code (KUHP) in 2026.
The signing was also followed by a cooperation agreement between the Regional Attorney's Office (Kejari) and the district/city government throughout Kaltara, Thursday, December 18.
This cooperation also involves PT Jamkrindo (Indonesian Credit Guarantee) as a state-owned enterprise (BUMN) which is engaged in the field of training and financing MSMEs.
The Governor of Kaltara Zainal A Paliwang said that this MoU regulates technical coordination for the implementation of social work, including the provision of social work facilities and locations, supervision and guidance mechanisms, data provision, and socialization to the community.
"This scheme is part of the implementation of Law Number 1 of 2023 concerning the Criminal Code, with the prosecutor's office as the executor of the court's decision," said Governor Zainal.
The Governor emphasized that the application of social work punishment was in line with the spirit of restorative justice.
"This approach places social recovery, the responsibility of perpetrators, and real benefits for the community as the main objectives of law enforcement," he said.
"Social labor is not only a sanction, but also a means of social education, character building, and strengthening concern for the environment," he continued.
Zainal said the synergy between the regional government and the prosecutor's office was not only at the provincial level, but was followed up to the district/city together with the local Kejari so that the implementation ran effectively and in accordance with the provisions of the law.
Meanwhile, the Head of the Kaltara Kajati Yudi Indra Gunawan revealed that social work as a new concept of imprisonment requires caution in its implementation.
"Penalization in any form is a restriction of a person's right to independence that is only allowed by law, so it must be carried out carefully and responsibly," said Yudi.
The main purpose of imposing a social work sentence, among others, is to reduce prison sentences, reduce the overcapacity of correctional institutions.
"As well as giving the convicts the opportunity to interact socially in a useful way, and realizing restorative and rehabilitative justice that is humanistic," he said.
