Minister of Law and Human Rights to Serve in Other Institutions in the Revision of the Police Law is Still Being Discussed
JAKARTA - The Minister of Law (Menkum) Supratman Andi Agtas said that the plan to make the Police Regulation (Perpol) Number 10 of 2025 as one of the materials for drafting the revision of the Law (UU) on the National Police will still be discussed first.
He emphasized that the perpol regarding the implementation of the duties of members of the National Police outside the organizational structure of the National Police, especially in 17 ministries/institutions, must be regulated, both in the law and the regulations below it.
"Yesterday it was conveyed by the National Police Chief. The results of the recommendations from the National Police reform team will also be discussed," said Supratman at the 2025 Year-end Reflection Press Conference in Jakarta, Thursday, quoted by Antara.
He did not deny that there was a controversy between Perpol 10/2025 and the Constitutional Court (MK) Decision Number 114/PUU-XXIII/2025.
However, according to him, the problem is a common thing because it is only a difference of opinion.
Even so, Supratman said the government and the House of Representatives (DPR) would adjust the dynamics that developed in the discussion of the Perpol.
"Moreover, believe me, the more days the public is more critical," he said.
Previously, the National Police Chief, General Listyo Sigit Prabowo, revealed his plan to make Perpol 10/2025 as one of the materials for drafting a revised Police Law.
The perpol, which was signed by the National Police Chief on December 9, 2025, regulates the assignment of police outside the organizational structure of the National Police, namely in 17 ministries/institutions. The regulation is considered contrary to the MK Decision 114/2025 which was announced on November 14, 2025.
"What is clear, this Perpol will certainly be upgraded to PP (government regulation, ed.) and then possibly included in the revision of the Law (Polri, ed.)," said the National Police Chief in answer to a journalist's question when he was met at the State Palace, Jakarta, Monday, December 15, after the Plenary Cabinet Meeting.
Listyo continued to respond to questions regarding the assignment of a number of police officers who are currently serving in environments outside the structure of the National Police after there was a decision by the Constitutional Court. According to the National Police Chief, the Constitutional Court's decision does not apply retroactively so that the officers who are currently serving outside the police structure can continue their assignments.
"For those who have already been processed, of course this does not apply to regression. The Minister of Law has conveyed this," said Listyo.
On the same occasion, the National Police Chief explained that Police Regulation Number 10 of 2025 was issued after consulting a number of ministries/institutions. The regulation was also issued in order to respect and follow up on the Constitutional Court's decision.
