Three Defendants in the LPEI Credit Corruption Case Sentenced to 4-8 Years in Prison

JAKARTA - Three defendants in a case of alleged corruption related to the provision of credit facilities by the Indonesian Export Financing Institution (LPEI) in the 2015-2018 period were sentenced to prison terms of 4 years to 8 years.

The three defendants, namely the President Director of PT Petro Energy Newin Nugroho who was sentenced to 4 years in prison, the Director of Petro Energy Susi Mira Dewi Sugiarta 6 years in prison, and the President Commissioner of Petro Energy Jimmy Masrindivonis 8 years in prison.

"The defendants have been proven legally and convincingly guilty of committing corruption crimes together and continuing as the first indictment of the public prosecutor," said Presiding Judge Brelly Yuniar Dienpadasidang reading the verdict at the Corruption Court at the Central Jakarta District Court, Tuesday, December 16, reported by ANTARA.

In addition to imprisonment, the three defendants were also sentenced to a fine of Rp. 250 million each, with the provision that if not paid, it will be replaced (subsider) for 4 months of imprisonment.

For Jimmy, the panel of judges also imposed an additional penalty in the form of payment of compensation for state losses in the amount of 32.69 million US dollars, in addition to 4 years in prison.

For their actions, the three defendants were charged with being guilty under Article 2 paragraph (1) in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) of the Criminal Code jo. Article 64 paragraph (1) of the Criminal Code.

Before sentencing, the Chief Judge stated that there were several aggravating circumstances that were considered, namely the actions of the defendants had become an obstacle to the government's efforts to prevent and eradicate corruption.

In fact, corruption, including serious crimes, which besides damaging state finances and the country's economy, can also hinder the progress of the country and nation.

"Therefore, the government is actively engaged in preventing and eradicating corruption. However, until now, corruption has still occurred," said the Chief Justice.

Then, specifically Susi and Jimmy, other aggravating acts that were considered were the treatment of not being honest in giving information.

Meanwhile, the mitigating circumstances considered by the panel of judges, namely the defendants have families who need the defendants.

Especially for Newin, the mitigating factor that is considered is to be honest in giving information.

The decision is lighter than the public prosecutor's demand. Previously, Newin was sentenced to 6 years in prison, Susi 8 years and 4 months, and Jimmy 11 years.

Likewise with the fine. Although the fine imposed on Newin and Susi is the same as the demand, the fine against Jimmy is lower than the demand of Rp. 400 million subsider 6 months in prison.

Even so, the additional penalty imposed on Jimmy remains the same as the charges.

In this case, the three were charged with causing damage to state finances of IDR 958.38 billion, by enriching Jimmy as the beneficial owner of Petro Energy by IDR 600 billion and 22 million US dollars or equivalent to IDR 358.38 billion (exchange rate of IDR 16,290 per US dollar).

The defendants, using a fictitious contract, allegedly applied for Petro Energy financing facilities to LPEI.

Then, the three of them were also charged with using underlying documents or underlying documents for disbursement in the form of purchase orders alias purchase orders (PO) and voice invoices that do not correspond to the actual situation to disburse financing facilities from LPEI to Petro Energy.

In addition, the defendants have used the credit financing facilities provided by LPEI to PT Petro Energy, which is not in accordance with the purpose of the financing facility.

It is stated that the defendants committed corruption together with the Managing Director of I LPEI Dwi Wahyudi and the Managing Director of IV LPEI Arif Setiawan, which was prosecuted separately.
