Denny Indrayana Warns of the Consequences of the MKMK Decision in the Arsul Sani Case
Expert on state governance law Denny Indrayana assessed that the decision of the Constitutional Court Honor Council (MKMK) regarding the alleged fake diploma of Constitutional Judge Arsul Sani should be an important reference in assessing other legal processes that are running. Because there is no violation of ethics committed by the former PPP politician.
"The one who was examined by the MKMK regarding the alleged ethics and the MKMK believes that there was no ethical violation. So, in fact, the MKMK believes that the S3 degree process obtained by Mr. Arsul is correct, so there is no ethical violation," said Denny when confirmed, Monday, December 15.
According to him, even though MKMK did not enter the realm of criminal law because it was outside its authority, logically the legal decision of the ethics had consequences. If there is no violation of ethics, then there should be no element of document falsification.
Although the criminal process is separate from the ethics mechanism at the MKMK, according to him, it will be problematic if the criminalization process does not go in line with the MKMK decision.
"It becomes problematic if the trial process does not comply with the MKMK decision. Because if the MKMK says there is no violation of ethics, it should also mean that the trial does not occur," said Denny.

However, Denny emphasized that the MKMK did not have the authority to decide on criminal cases, so the legal path remained in the hands of law enforcement officials.
"Again, the process of sentencing is not the authority of the MKMK to decide," he said.
It is known that the MKMK in its decision on Thursday, December 11, 2025, concluded that Constitutional Judge Arsul Sani was not proven to have committed an act that was suspected of violating ethics associated with the falsification of documents or intentionally using documents, in this case a doctoral education diploma, false in fulfilling the requirements as a judge.
On the other hand, the case of the alleged fake diploma was reported by a number of parties to the Criminal Investigation Unit of the National Police.
