JAKARTA - Otto Hasibuan's lawyer spoke up regarding the controversy over the siri marriage between Insanul Fahmi and Inara Rusli, which later became a public discussion. According to him, the practice of siri marriage is still common in Indonesia, but carries serious legal consequences.

Otto emphasized that a siri marriage does not have legal force because it is not officially recorded by the state. This condition has the potential to cause problems if there is a dispute later.

He explained that the absence of a marriage certificate makes the couple who marry siri not able to take legal action if a conflict arises.

"If we talk about the process in court, because there is no marriage certificate, then it cannot go through the legal process," he said.

Otto also emphasized that a siri marriage can only be considered not problematic if it has permission from the legal wife. Without this permission, a siri marriage has the potential to cause legal problems.

"Talking about marrying a series must certainly get permission from the original wife. If there is no permission, then it will be a problem," he said.

He added, if the husband lies about the marital status, the risk is even greater.

"If the husband lies, then it means that he has harmed his legitimate wife and lied to both parties. That can get serious legal problems," Otto said.

According to him, under certain conditions, the practice of secret marriage without the permission of the legal wife also has the potential to be charged with criminal offenses, including fraud, although not always in the form of material losses.

"It can also be included in the fraud article even though it is not in the form of goods. In the old days, it was considered strong," he said.

However, Otto considered that the issue was more appropriately categorized as adultery.

"Actually, a problem like that can best be said to be fornication or adultery and it can be reported," he said.
