U.S. Bule Sentenced To 3 Months In Prison For Broken Neighbor's Door In North Kuta
DENPASAR - A foreign national from the United States named Christian Toolan was sentenced to three months in prison for the destruction of the gate of his neighbor's house in Badung, Bali.
"Prosecuting, declaring the defendant Christian Toolan has been proven legally and convincingly guilty of criminal destruction as the prosecutor's indictment," said the panel of judges led by I Wayan Gede Rumega in a hearing at denpasar district court quoted Antara, Tuesday, May 25.
In this case, the U.S. bule was found to have violated Article 406 Paragraph (1) of the Criminal Code. There is also evidence in this case, namely two photos of the gate of the house in a state of disrepair, two pieces of iron photos of the gate buffer of the house in a state of disrepair and two photos of the door of the house in a state of disrepair.
Against the verdict, defendant Christian Toolan through his legal counsel expressed his thoughts. Meanwhile, Public Prosecutor A. A. Made Suarja Teja Buana said he accepted the verdict.
Earlier, U.S. Public Prosecutor Made Suarja Teja charged the defendant with five months in prison, minus the period of detention the defendant had served.
The vandalism occurred on Thursday, March 11 at around 11:30 p.m. in Perum Lebah Sari, North Kuta. At that time, the defendant's wife woke him up from hearing a neighbor's dog barking.
Furthermore, the defendant had a chance to find and call the homeowner of the dog, but there was no answer. Then, the defendant wanted to enter the victim's house but could not so the defendant immediately kicked the gate of the victim's house and forced to pull the gate until the gate buffer crooked.
After that, the victim woke up and tried to block the accused from entering the house. However, it was found that the door of the victim's house was kicked by the accused.
Knowing this, the victim fought back until there was a fight between the two. So the victim reported the incident to the police.
