Batam District Court Sentenced Employer Aniaya PRT Sentenced To 10 Years In Prison
The panel of judges at the Batam District Court (PN), Riau Islands, sentenced Roslina, a defendant in the crime of mistreatment of Intan Tuwa Negu (20), a household worker (PRT) with a prison sentence of 10 years in prison.
The verdict was read out by a panel of judges led by Andi Bayu and two judges from Dauglas and Dina Puspasari.
The judge stated that Roslina had been legally and convincingly proven guilty of committing a criminal act of participating in physical violence in the household which resulted in the victim's serious injuries continuing as in the primary indictment.
"Second, sentenced the defendant to 10 years in prison," said Judge Andi Bayu as quoted by ANTARA, Monday, December 8.
In that decision, the judge did not see anything mitigating from Roslina in the case of domestic violence. The judge assessed that the defendant's actions were classified as sadistic and repeated, so that Intan's victim suffered physical injuries and psychological trauma continued.
According to the judge, the thing that incriminated the defendant was his act of causing the victim to fall ill, and psychological trauma, causing deep wounds for the victim and his family.
"The defendant's actions were carried out in sadistic and repeatedly and the victim did not forgive the defendant's actions," said Andi.
In addition, the defendant Roslina was also complicated in providing information and did not admit her actions.
"The defendant's actions caused widespread unrest in the community," continued Andi.
The judge also ordered the defendant to remain in custody, and the detention period since the arrest was made was reduced from the verdict handed down.
The verdict of the panel of judges is in accordance with the demands submitted by the Public Prosecutor (JPU) of the Batam Kejari.
Apart from Roslina, the panel of judges also sentenced Marliyati (21), another defendant, who is also Intan's cousin.
The judge stated that Marliyati was legally and convincingly proven to have come down and committed physical violence which resulted in the victim's serious injury continuing.
The thing that burdens the defendant Marliyati who was forced by Roslina to commit violence against Intan was her act of causing physical and psychological trauma to the victim and her family. As well as these actions cause widespread unrest in the community.
"The thing that makes it easier for the defendant to admit his actions, and the victim has forgiven the defendant," said judge Andi.
Separately, Chairman of the Commission for Peace Justice and Pastoral Migrants of the Riau Islands Mitau (KKP PMP Kepri) Romo Pascal assessed that the decision of the Batam District Court judges was maximal and had fulfilled the victim's sense of justice.
However, Father Pascal stressed that no matter how many sentences were handed down to the defendant, it could not relieve Intan's trauma.
"Our process is how to ensure Intan must be able to recover, hopefully this 10-year sentence will be enough to entertain her, meaning that she can feel justice," said Father Pascal.
The case of abuse experienced by Intan as RRT in Batam received attention from the Minister of Women's Empowerment and Child Protection (PPPA) Arifah Fauzi.
Arifah expressed deep concern over the case of violence that befell Intan. Also stated that he would oversee the development of this case to ensure that the law enforcement process runs according to applicable regulations.
"We strongly condemn the acts of violence committed against the victim who is a domestic worker. This incident again reminds us that the issue of PRT protection must be of common interest, including ensuring that the legal process runs according to the provisions," said PPPA Minister, Arifah Fauzi.
