The Criminal Adjustment Bill Includes Articles On Narcotics That Have Not Been Regulated

JAKARTA - Commission III of the DPR RI and the government have agreed to include articles on narcotics that have not been regulated in the new Criminal Code (KUHP), to fill the legal vacuum.

Deputy Minister of Law Eddy Hiariej said that in the previous preparation of the Criminal Code, several articles related to narcotics were revoked because they would be regulated in the new Narcotics Bill (RUU). However, the bill has not yet been completed.

"It turns out that it has not been completed, so the articles that have been revoked are returned again," said Eddy during a working committee meeting of the Criminal Adjustment Bill at the Parliament Complex, Jakarta, Antara, Monday, December 1.

He said the articles revoked from the Criminal Procedure Code and will now be included in the Criminal Adjustment Bill, the element of the offense has not changed. One of them is the elimination of minimum crimes specifically for narcotics users.

"The special minimum is removed for users and then the sanction becomes the cumulative alternative and/or," he said.

Then, there is also an article on the conversion of fines that are adjusted to the category of fines regulated in the new Criminal Code.

"In substance, we will return it in accordance with the old narcotics law, the elements are the same so that law enforcers are not confused in law enforcement," said Eddy.

However, in the future, he said that the improvement of these articles would be carried out through the Psychotropic and Narcotics Law which is still being drafted.

"So, ladies and gentlemen, these additional articles are like emergency doors so that there is no legal vacuum," he said.
