Maria Lumowa Bank Bni Break-in Sentenced To 18 Years In Prison, Pay Replacement Money Rp185 Billion
JAKARTA - Accused of bank break-in of BNI Kebayoran Baru Branch, Maria Pauline Lumowa was sentenced to 18 years in prison. Maria Lumowa was also fined Rp800 million for 4 months of confinement.
"Declaring the defendant Maria Pauline Lumowa is proven legally and convincingly guilty of committing a crime of corruption committed jointly and continues and committed a crime of money laundering," said the presiding judge, Saifudin Zuhri in a hearing at the Tipikor Court, Jakarta, Monday, May 24.
Not only criminal convictions and fines, Maria Pauline who caused state losses amounting to Rp1.2 trillion is also obliged to pay compensation of Rp185 billion. If unable to pay the replacement money then the defendant will be sentenced to 7 years in prison.
"Punishing the defendant to pay a replacement fee of Rp 185,822,422,331.43, provided that if he does not pay the replacement money after the judge's decision remains then his property is entitled to be auctioned by the prosecutor, if the convicted does not have money to pay the replacement money then it is replaced with a prison sentence of 7 years," saifuddin said.
The decision, Saifudin continued, was based on several considerations. For the incriminating matter, Maria is considered not to support the government's program in eradicating Corruption, Collusion and Nepotism (KKN).
"It does not support the KKN program and the defendant has held DPO status for several years," he said.
As for the lightening, Maria was never criminally punished until the assets were confiscated.
"Never been convicted, be polite during the trial, the company's assets under Gramarindo Group have been confiscated on behalf of convicted Adrian Herling Waworuntu," he said.
Maria Lumowa was declared in violation of Article 2 paragraph 1 Jo Article 18 of Law No. 31 of 1999 concerning Tipikor as amended by Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999 concerning Tipikor Jo Article 55 paragraph 1-1 of the Criminal Code Jo Article 64 paragraph 1 of the Criminal Code.
Maria also violated Article 3 paragraph 1 letter a Law No. 15 of 2002 on the prevention and eradication of TPPU as amended by Law No. 25 of 2003 on amendments to Law No. 15 of 2002 on Prevention and Eradication of TPPU.
