Minister Of ATR Conducts Legal Due Diligence Handling Land Problems Jusuf Kalla

JAKARTA - Minister of ATR/BPN Nusron Wahid said that his party was conducting legal due diligence to deal with the land feud between Jusuf Kalla and Lippo Group.

"Currently, we are doing legal due diligence. Legal due diligence, which process is the most proper and the most correct. It can't be true. Because there is one object, 2 objects must be wrong, right? Sir? We are doing this," said Nusron at the DPR building, Senayan, Jakarta, Monday, November 24.

"It's just that we haven't been able to answer which one is wrong and which one is right. We're doing legal due diligence," he continued.

After that, said Nusron, the ATR Ministry would summon both parties for mediation.

"But it was Pak JK's first and he has been extended. But about 70 percent of that first is usually true. Even though it doesn't guarantee that later it must be wrong or not. But the initial indication is like that. We will prove it later. After that, we will call both of them," he said.

Regarding the schedule for the summons, Nusron could not comment. "Yes later," he said.

As is known, the feud between the Lippo Group of PT Gowa Makassar Tourism Development Tbk. (GMTD) and PT Hadji Kalla regarding the ownership of 16 hectares of land in the Tanjung Bunga area is still heating up. Each party stated that they were the legal owners of the dozens of hectares of land.

GMTD President Director Ali Said, said the legal basis for the Tanjung Bunga area was determined by state documents, not unilateral claims. The Tanjung Bunga area has been designated by the government as an integrated tourism area which is entirely under the single mandate of PT GMTD.

This was determined through the Decree of the Minister of PARPOSTEL July 8, 1991, the Decree of the Governor of South Sulawesi November 5, 1991 (1,000 Ha), the Decree on the Confirmation of the Governor January 6, 1995, and the Decree on Confirmation & Prohibition of Land Mutation January 7, 1995.

These four state documents explicitly state that only PT GMTD has the authority to buy, free, and manage land in the Tanjung Bunga area. Then, no other party is allowed to process or own land during that period.

Meanwhile, Jusuf Kalla, through his spokesman, Husain Abdullah, responded to the accusation that PT Gowa Makassar Tourism Development Tbk. (GMTD) which stated that the ownership of 16 hectares (Ha) of PT Hadji Kalla had no legal basis.

Husain explained that the legal basis for PT GMTD's land ownership, which was actually claimed to be inconsistent. The reason is, the principle according to Governor Decree No. 118/XI/1991 which holds the Lippo Group-GMTD is for tourism purposes, not for real estate or the sale and purchase of land such as in Tanjung Bunga, Makassar.
