KPK Asks For Ira Puspadewi Et Al's Decision Not To Make SOE Directors Fear: As Long As It's In Accordance With BJR, No Problem

JAKARTA - The Corruption Eradication Commission (KPK) said that the board of directors of SOEs should not hesitate to make decisions. As long as they comply with the applicable regulations, they will definitely avoid the legal process.

This was conveyed by KPK spokesman Budi Prasetyo in response to the narrative circulating about the decision of the former President Director of PT ASDP Indonesia Ferry (Persero), Ira Puspa Dewi et al. can make SOE directors afraid when making decisions.

Ira is known to have been sentenced to 4.5 years in prison and a fine of Rp. 500 million by the Jakarta Corruption Court in the corruption case of PT Jembatan Nusantara's business cooperation and acquisition by ASDP.

Meanwhile, former Director of Planning and Development of PT ASDP, Harry Muhammad Adhi Caksono, and former Director of Commercial and Services of PT ASDP, Muhammad Yusuf Hadi was sentenced to 4 years and a fine of Rp250 million. They were found guilty and committed corruption together as the second alternative indictment Article 3 in conjunction with Article 18 of Law Number 31 of 1999.

"Observing this fact, the KPK also urges and invites corporations not to hesitate in the decision-making process," Budi told reporters at the ACLC KPK building, Rasuna Said, South Jakarta, Monday, November 24.

Budi said the directors actually had a guide, namely the business judgment rule in the decision-making process. "As long as it's done, it doesn't matter," he said.

As for the case that dragged Ira et al, Budi said, there were a number of personnel in the implementation of acquisition and business cooperation. For example, an assessment of old ships.

"Of course it is also a time of benefit or its value is not optimal," he said.

PT Jembatan Nusantara also has a bad financial condition with a number of debts that have not been paid. So, Budi said, the acquisition made ASDP have to bear obligations.

Then, other Ira et al have committed acts against the law that benefit a number of parties. Budi said, state losses can be calculated without any profits being covered by the defendants.

"Including the question of 16 of the 53 ships that arrived in March 2025 yesterday, they are still at the shipyard, they are still being docking," explained Budi.

As for the trial of Ira's case in the spotlight after the Chief Justice of the Panel of Judges, Sunoto stated that Ira Puspadewi et al should be acquitted or onslag. He took the option of dissenting opinion because the acquisition of PT JN by ASDP was not entirely convincing as a criminal act of corruption.

Sunoto also said that the punishment for Ira Puspadewi et al also had a negative impact on the business world, especially SOEs. The board of directors can be afraid to make decisions for fear of experiencing a similar fate.

"The best professional-professional will think many times to accept the leadership position in BUMN because they are worried that any non-optimal business decisions can be criminalized," Sunoto said in a verdict hearing, Thursday, November 20.
