Double Claims, Transfer Of Functions, Historical Documents Lost Is The Main Problem Of TNI Assets

JAKARTA - Deputy Minister of Agrarian Affairs and Spatial Planning/Deputy Head of the National Land Agency (ATR/BPN) Ossy Dermawan revealed that there were three land cases involving assets belonging to the TNI.

First, disputes or multiple claims, which often arise because regional boundaries are not clear or old documents disappear.

Second, the conversion of functions and utilization is not appropriate, namely that the TNI's assets have changed to commercial or labored land facilities through certain cooperation.

"Well, this change can certainly cause legal problems in the future," said Ossy, quoted from the official website of the Ministry of ATR/BPN, Tuesday, November 18.

Third, historical documents are missing or incomplete.

This is because many land assets in the defense sector are inherited from the colonial period or the beginning of independence.

So that the transfer of rights document or legal basis is no longer intact, damaged or not entered into the modern administration system.

This condition makes the certification process often hampered because it is difficult to find authentic evidence of state ownership.

According to Ossy, the problem is rooted in several structural problems, ranging from long historical heritage, administrative data is not yet uniform to the lack of inter-institutional synchronization.

So far, there are 527 land cases in the defense sector, the majority of which are related to uncertified assets.

"This is our homework together and the Minister is committed to resolving the confusion of this inter-institutional data," he said.

He explained that a number of impacts could arise if this problem was not resolved immediately.

In terms of law, the state has the potential to lose the right to defense land because it does not have valid ownership evidence.

Meanwhile, in terms of defense, some facilities are at risk of not being safe, such as direct training ground with settlements.

"Sehingga bapak-bapak sekalian, tugas kami bukan mencari siapa salah atau benar, tetapi memastikan tanah pertahanan negara tidak lagi mengambang status hukumnya. Ini menjadi komitmen kami di Kementerian ATR/BPN untuk mendukung TNI, khususnya TNI Angkatan Darat," imbuhnya.

As for the social side, tensions can arise with people who consider military land as free land.

Meanwhile, in terms of governance, the assets of vulnerable countries are not optimal and easy to misuse.

"So ladies and gentlemen, our job is not to find out who is wrong or right, but to ensure that the country's defense land is no longer floating in its legal status. This is our commitment at the Ministry of ATR/BPN to support the TNI, especially the Army," he added.
