Retired From The Police, The KPK Believes That The Constitutional Court's Decision Will Not Disrupt The Position Of Chairperson Of Setyo Budiyanto
JAKARTA - The Corruption Eradication Commission (KPK) ensures that the latest Constitutional Court (MK) decision, which prohibits members of the National Police from actively holding civilian positions, will not affect the position of chairman, Setyo Budiyanto.
The KPK spokesman, Budi Prasetyo, emphasized that the process of selecting Setyo Budiyanto as Chairman of the KPK had gone through a rigorous selection mechanism and a fit test at the DPR RI.
"Initially the process went through a selection committee that provided opportunities for all eligible Indonesian citizens," Budi told reporters in a written statement, Tuesday, November 18.
In addition, Budi emphasized that Setyo Budiyanto's current status is no longer an active member of the National Police, but has retired.
"There is no implication," said Budi. Because the status of the KPK chairman is retired from the National Police," he continued.
The Constitutional Court's Decision And Its Impact
The Constitutional Court's decision Number 114/PUU-XXIII/2025 was read out on Thursday, November 13. This decision grants all lawsuits against Article 28 paragraph (3) of Law Number 2 of 2002 concerning Police (Police Law).
Specifically, the Constitutional Court removed the phrase "or not based on the assignment from the National Police Chief" in the Explanation of Article 28 paragraph (3) of the Police Law. This abolition was carried out because the phrase was considered a legal loophole for active police to occupy civilian positions without the need to resign or retire.

Responding to this decision, Member of Commission III of the Indonesian House of Representatives, Benny Kabur Harman, hoped that President Prabowo Subianto would take immediate action. He urged the President to withdraw all active members of the National Police who currently occupy civilian positions.
Benny believes that President Prabowo will obey the constitution, considering that the Constitutional Court's decision has final and binding properties (finals and bindings).
"President Prabowo is a president who obeys and obeys the constitution. Therefore, we expect President Prabowo to immediately withdraw and return members of the National Police who are still active in ministries and institutions or agencies," said Benny K Harman to reporters, Friday, November 14.
"Or they are asked to choose whether to retire early or immediately return to their parent organization," said Benny.
