Komposer Gives Input On The Copyright Bill To The Legislative Council Of The House Of Representatives, Asks For Royalty Payments To Be Made Before The Show
JAKARTA - The Legislation Body (Baleg) of the DPR RI held a public hearing (RDPU) with the All-Indonesian Composters Association (AKSI), the Indonesian Voice Vibration (VISION), the Indonesian Recording Industry Association (ASIRI) related to the harmonization of the Copyright Bill.
Chairman of the Association of Indonesian Composters (AKSI), Satriyo Yudi Wahono or Piyu Padi, submitted eight proposal points in the Copyright Bill. One of them is related to royalty collection carried out before the performance.
"Here we want to convey what is the need for the revision of the Copyright Law. Currently, the system running in the field does not show an ideal system in the governance of national royalties which in turn often creates confusion and uncertainty for industry players," said Piyu in a meeting at the Nusantara I building, DPR/MPR complex, Senayan, Jakarta, Tuesday, November 11.
Piyu then submitted eight recommendations regarding the revision of the Copyright Law. First, encouraging the mandatory provisions for permits or licenses before music performances and royalty payments made before the event takes place.
"We convey our reason why it is like this, because according to the 2016 Decree from the Ministry of Law and Human Rights, it still states that royalties collection and royalty distribution are carried out after the performance or concert takes place. So it means that after the ticket concert performance which is sold 2 percent, the technique is like that and 2 percent of the production value of an event. But it was taken or collected after the show. This shows that these creators also bear the same risks as the organizers," he explained.
"The rights that are accepted should be delayed and violations or transactional violations occur inside, because there is evidence that we can convey that in collecting royalties after the concert, it never matches the sheet or data that should be," continued the guitarist of the Padi Band.
Second, ACTION considers the need to strengthen the definition of public services clearly. Third, encourage special provisions for music performances. Fourth, encourage the existence of fair direct license and opt-out LMK rules. Fifth, encourage the presence of LMK specifically for music performances.
Sixth, encouraging the empowerment of the digital subciption system for license license certificate royalties. Seventh, supporting the efficiency of the number of LMK. Eighth, encouraging the presence of regulations that make AU rules and piracy.
Meanwhile, Chairman of the House of Representatives Baleg Bob Hasan said that the harmonization of the Copyright Bill was not only about articles, but also the roles of stakeholders who would later together harmonize from the existing legal vacancies. So that a legal revision of the law on copyright was formed.
"That's the point so that our vision is the same," said Bob Hasan.
Bob said the Copyright Bill aims to provide protection for players in the entertainment industry. It will accommodate the aspirations of many parties.
"The main reason is, firstly, this bill aims to provide more optimal protection for creators, copyright holders, and owners of related rights, ACTION represents creators or composers who have moral rights and economic rights to their copyrights, while VISI represents show actors who have related rights," said Bob.
