KPK Executes Three Former Waskita Karya Officials To Prison
JAKARTA - Kpk executed three former institutions of PT Waskita Karya (Persero) who had received a permanent legal ruling to two different correctional institutions.
The three are former Head of Civil Division/Division III/Division II of PT Waskita Karya 2008-2011 Desi Arryani, former Head of Normalization Project of Kali Bekasi Hilir Fakih Usman and former Head of Finance of Civil Division III PT Waskita Karya Yuly Ariandi Siregar.
"On Thursday, May 21, KPK Execution Prosecutor Andry Prihandono has executed the verdict of PN Tipikor at PN Central Jakarta Number: 59/Pid.Sus/TPK/2020/PN. Jkt. Pst dated April 26, 2021 with convicted Desi Arryani et al," said Acting Kpk Spokesman Ali Fikri in Jakarta, reported antara, Friday. May 21.
Convicted Desi Arryani was executed to Class II Correctional Institution A Tangerang to serve a prison sentence of 4 years reduced while in custody.
"Previously convicted Desi Arryani has been convicted and found guilty of corruption crimes together and also burdened with paying a fine of Rp200 million provided that the fine is not paid replaced with a criminal confinement for two months," said Ali.
Ali stated that additional criminal payments in the form of replacement money amounting to Rp3.415 billion have been paid through kpk shelter accounts.
"Convicted Fakih Usman was admitted to Sukamiskin Correctional Institution class I to serve a prison sentence of 6 years reduced while in custody," Ali said.
Fakih Usman has been found guilty of corruption crimes together and also charged with paying a fine of Rp200 million provided that the fine is not paid is replaced with a 2-month prison sentence.
While additional criminal payments in the form of replacement money amounting to Rp5,970,586,037 have not been repaid and must be repaid no later than 1 month after the verdict obtained a permanent legal force.
"If in that time is not paid then his property is confiscated and auctioned to cover the replacement money and if the replacement money is not paid then sentenced to prison for 2 years," said Ali.
Lastly convicted Yuli Ariandi Siregar was executed to Sukamiskin Class I Correctional Institution to serve a prison sentence of 7 years reduced while in custody.
Yuli was found guilty of corruption jointly and also charged with paying a fine of Rp200 million provided that the fine was not paid in exchange for a two-month prison sentence.
"The convict is also still charged in the form of payment of replacement money amounting to Rp47,166,931,587 no later than 1 month after the verdict obtains a permanent legal force and if in that time is not paid then his property is confiscated and auctioned to cover the replacement money and if the replacement money is not paid then sentenced to prison for 2 years and 6 months," said Ali explained.
All three were proven to have committed acts as threatened by Article 3 jo Article 18 of Law No. 31 of 1999 as amended by Law No. 20 of 2001 jo article 55 paragraph 1-1 of Article 65 paragraph 1 of the Criminal Code.
In this case, the convicts were proven to raise funds "non budgeter" by making contracts of fictitious subcontractor jobs attached to the main projects carried out by PT Waskita Karya which later payment for the works to the fictitious subcontractor companies were returned (cash back) to PT Waskita Karya thus harming the state's finances up to Rp202.296 billion for making 41 fictitious employment contracts.
Designated fictitious subcontractor companies are given a "fee" of borrowing a flag of 1.5-2.5 percent of the contract value.
There are two other defendants who have not received a verdict of permanent legal force, namely the former Head of The East Canal Development Project – Package 22 of PT Waskita Karya Fathor Rachman and the former Head of Control Ii Division II of PT Waskita Karya Jarot Subana for appealing against the decision of the first-level judges.
