Nusron Wahid Targets Tanah Waqf Commercialization Regulations To Be Completed By The End Of 2025
JAKARTA - Minister of Agrarian Affairs and Spatial Planning/To the Land Agency (ATR/BPN) Nusron Wahid targets that the Government Regulation (PP) regarding the permit to commercialize productive waqf on waqf land will be completed by the end of 2025.
"God willing, it will be at the end of the year (the rules for commercialization of productive waqf)," said Nusron after giving a certificate of use rights belonging to the Ministry of Foreign Affairs (Kemenlu) to Foreign Minister Sugiono at the Ministry of Foreign Affairs office, Jakarta, Thursday, November 6.
So far, Nusron is consulting with the National Sharia Council (DSN) and the Indonesian Waqf Agency (BWI) regarding the fatwa of the issue.
"Because, the fatwa among the scholars about this opinion is still different," he said.
Nusron explained that the consultation was needed so as not to become a wild debate in the community.
According to him, the regulation can later be aligned with the Management Rights Certificate (HPL).
Thus, certificates of Building Use Rights (HGB) on waqf land can be built tall buildings such as malls, hotels, hospitals and others.
The revenue from the building will later be used by nadzir waqf for the benefit of the people.
"So that waqf land does not die, not only for prayer purposes, not only for school interests, but can be commercialized. However, the money is returned to nadzir waqf for the benefit of the people, the language is so," he explained.
He explained that there were two waqf utilizations, namely muqayyad or only for the benefit of the mosque, or ghairu muqayyad, namely mosques and the interests of the people.
The DSN-BWI study leads to a provisional conclusion that determines the legality of commercialization, namely the intention of wakif (the waqf) when announcing the waqf.
In other words, if the waqf pledge states that the land is used "any for the benefit and benefit of the people", later on the land can be issued the Right to Use Business (HGU) or Building Use Rights (HGB) within a certain period of time.
In this scheme, the waqf status is not lost. Waqf land remains an asset of the people and does not switch ownership. Then, HGU / HGB can be issued on waqf land.
