Regarding The Prosecutor's Indictment, Attorney For Kompol Yogi, Defendant Of The Murder Of Brigadier Nurhadi: Assumption
JAKARTA - Kompol I Made Yogi Purusa Utama's legal team, the defendant in the murder of Brigadier Muhammad Nurhadi who died at a Gili Trawangan inn, stated that the indictment of the public prosecutor (JPU) was based on imagination and assumptions alone.
"So, we conclude that the indictment drawn against our client is based on the results of imagination and assumptions, not based on the facts of the investigation," said Hijrat Prayitno representing the legal team of Kompol Yogi after the follow-up trial of the agenda for reading the exception on the prosecutor's indictment at the Mataram District Court, Monday, was confiscated by Antara.
As the results of the reconstruction that took place at the scene, namely at a closed inn located in Gili Trawangan, North Lombok Regency. According to Hijrat, there are several things that the prosecutor did not include in the indictment.
"One example of the reconstruction results in scene 22 A. There was a defendant being carried into the room by witness Aris and the deceased (Brigadi Nurhadi) because they lost consciousness," he said.
Then, at around 21.05 WITA, Kompol Yogi was woken up from sleep by witness Misri and immediately sat on the front seat of the room with a small pool in the middle of the closed inn area.
"When we got up, sitting in front of the inn room, our client was told that witness Misri had a victim at the bottom of the pool, at that time the defendant was trying to save him," he said.
Furthermore, the contents of the indictment that seemed far-fetched were related to the actions of Kompol Yogi who tied the victim's neck. He stated that none of the witness statements at the investigation stage revealed the criminal incident.
"We asked where the prosecutor got the facts from, from whose witnesses, from what evidence, none of the reconstructions said there was a permit," he said.

Likewise, the position of the victim died not at the inn location, but at the clinic where the victim received medical assistance at Gili Trawangan.
"That, leaving the hotel, the victim was paired with oxygen saturation, put in an IV, brought using cidomo to the clinic. There was a chance that the victim fell from Cidomo," he said.
From the exception submission at the trial, Hijrat represented the defendant's legal advisory team Kompol Yogi hopes that the panel of judges will see this case objectively.
"We also want to help so that this trial can reveal the facts that actually happened in this incident," he said.
The same thing was also conveyed by the defendant Ipda I Gde Aris Chandra Widianto through his team of legal advisors who stated that the prosecutor's indictment was not based on the facts of the investigation, but more imaginary.
Ipda Aris' legal advisory team highlighted the application of criminal articles that were considered not based on legal facts in the death of Brigadier Nurhadi.
Ahmad Budi Muklish representing the Public Prosecutor's team saw that the exception material of the two defendants had been included in the subject discussion of the case.
"Of course it needs proof, and our job from the prosecutor is to prove it at trial," said Budi Muklish.
