Many Photos Of Yu, Komdigi Affirms Residents Can Sue The Sales Of Runner Photos Without Permission

JAKARTA - Recently, the photo marketplace based on artificial intelligence (AI), FotoYu, became the talk of the public on social media because the platform contained photos and sold them without permission from the person concerned.

This marketplace is becoming famous for many street photographers starting to capture runners' moments at large and small running events, and selling them in FotoYu.

Some netizens assess that the buying and selling of photos in this marketplace violates someone's privacy because there is no permission from the person concerned. However, some people have no problem with this.

Seeing this trend, the Director General of Digital Space Supervision of the Ministry of Komdigi, Alexander Sabar, emphasized that shooting activities or photography activities carried out in public spaces must comply with the provisions in Law Number 27 of 2022 concerning Personal Data Protection (UU PDP).

"A person's photo, especially those that display individual faces or characteristics, is included in the category of personal data because it can be used to identify a person specifically," Alex said in his official statement on Wednesday, October 29.

Alex also emphasized that photos showing a person's face include personal data and should not be distributed without permission. To that end, Alex reminded photographers, to respect copyright and the right to self-image.

Alex also said that the public has the right to sue parties who violate or misuse personal data as regulated in the PDP Law and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE).

In the future, Komdigi will invite representatives of photographers and professional associations such as the Indonesian Pharmaceutical Professional Association (APFI) and related Electronic System Operators (PSE) to strengthen understanding of legal obligations and photography ethics in the digital space.
